因为跟车版的法盲较真,本小白专门给德州政府发了信。现在奥斯丁回信详细回答了我
的疑问。
信原文我附在下面。这里给个Abstract:
1.限速是严格限速,没有理由可以超速。
2.“follow traffic is safter”的说法不对。要求不能跟着超速的车开。
3.“因为开太慢被追尾是前车责任”的说法不对,这通常说明后车“Fail to Control
Speed”。
美国好,大家都承认。大家也都羡慕他这里法制比较好,大家比较守规矩。然后中国法
制建设是比较差,成天指责政府有法不依神马的。然后自己也有法不依,你们还有资格
说什么吗?上梁不正下梁歪呗。哼哼。正在考虑下次碰上集体大超速的就打911报警。

Answer to Your Speed Limit Question
Good afternoon,
In response to your question below regarding ‘how serious is speeding
limits’?
Violating speed limits are a very serious and an important part of vehicle
travel safety of those on Texas roadways. Speed limits are set up after
speed surveys are done in a particular area or particular expanse of roadway
to determine what the safe limit of that roadway should be. The
determining factors are 1) the roadway itself (which includes its age,
composition, how wide it is), the topography of the land (how up or down it
is or the number of curves or sight restrictions, etc.) and lastly, how
many vehicles travel on the roadway per day. After the speed limit is
established, this speed limit is the ‘prima facia’ speed limit for that
section of road. This means the maximum speed you can travel on this road
when conditions are perfect or optimal. (No bad weather, no wet or icy
roads, no fog, no high wind and limited number of vehicles on the road, etc.)
We take speed limits VERY seriously and expect all Texas drivers to respect
them and obey all speed limits posted. Any one operating their vehicle
above the posted speed limit are subject to being stopped for speeding.
That is why we ask EVERYONE to follow the speed limits very closely.
In response to your second comment regarding ‘it is safer to follow the
traffic no matter how fast they are driving, even if they exceed the speed
limit’.
We ask that no one follow someone speeding as both are subject to being
stopped for speeding violations and if they have a crash, the severity crash
will be worse than at lower speeds.
In response to your third comment regarding ‘it is also believed that
drivers are responsible for a rear-end accident if they drive slower than
the traffic even they are already driving at the speed limit’.
That belief or assumption is incorrect. The vehicle traveling behind that
hits a vehicle ahead of it is ‘usually’ in violation of failing to control
their speed. If you are driving the speed limit and are hit from behind,
usually the driver hitting you from behind would be in violation of ‘Fail
to Control Speed’. All drivers are required to exercise due caution,
proceed in a safe manner and MUST be in control of their vehicle at all time
. If there a number of vehicles traveling above the speed limit and you do
not feel safe, we ask that you keep to the right traffic lane if you are in
a multi-lane roadway. If you are in a single lane, pull to the right
occasionally to allow vehicles crowding you from behind to pass and this
will limit their distraction to you.
If you follow the speed limit law at all times you will more times be safe
and not responsible for accidents. Our troopers and other law enforcement
do not find ‘responsibility’ or ‘fault’ for crashes but find violations
of the law occurring during those crashes and issue the proper enforcement
action on those violations clearly present.
We ask all persons using Texas roads to utilize due care and be respectful
of other drivers sharing the roadways with us!! Hopefully this has answered
