我也在找答案。老印网上说没问题。估计对H、L身份可能没问题。
HL没有AP离境也不影响AP、485批准。新AP在境外披了也应该有效的。

22. 宋江为何要私放晁天王？
“生辰纲”被劫之后，上级官府差人去济州下公文，限期济州市长十天之内破案，
若十天之内破不了案，就要“请”他到沙门岛走一遭。（流放）
府尹大惊，马上把公安局长何涛叫来，大骂一顿，说他不用心缉捕，恐吓道：“先
把你这厮迭配远恶军州，雁飞不到去处。”便唤过文笔匠来，去何涛脸上刺下“迭配..
.州”字样，空着发配州名。喝道：“何涛，你若获不得贼人，重罪决不饶恕。”
何涛四处打探消息，终于捕获了白日鼠白胜。白胜交代了犯罪经过，把晁盖供出来
了：“郓城县东溪村晁保正。”
于是，何涛便去郓城县捉晁盖。
这一次抓捕行动是非常秘密的。先是“三更”时分，抓住白胜，逼出口供，然后，
“星夜”来到郓城县。
按说，是不会走漏消息的。
那何涛来到郓城县县衙门口。只见县里走出一个吏员来——这个人，便是宋江。
这是宋江第一次出场，在小说的第十八回：
那押司姓宋名江，表字公明，排行第三，祖居郓城县宋家村人氏。为他面黑身矮，
人都唤他做黑宋江。又且于家大孝，为人仗义疏财，人皆称他做孝义黑三郎。……平生
只好结识江湖上好汉。
当时，宋江见了何涛，问：上司到弊县来，不知有何公务？
何涛就把来捉晁盖的事都说了。
宋江听罢，吃了一惊，肚里寻思：“晁盖是我心腹弟兄。他如今犯了迷天之罪，我
不救他时，捕获将去，性命便休了。”然后，畔住何涛喝茶，自己转身就去给晁盖报信
，叫他快跑！
那么，宋江为什么要私放晁盖呢？
仅凭“心腹弟兄”是说不通的。虽然嘴上说的是“心腹弟兄”，但实际上，仅仅就
只是“认得”而已。也谈不上有什么深厚交情。
1. 晁盖七人聚在一起密谋“生辰纲”时，从头到尾，压根就从来没提到过还有宋
江这个心腹弟兄。
2. 晁盖天天和吴用聚在一起商量，这两个才是走的最近的人！关系不是一般的密
切！
3. 吴用却问道：“正是谁人？”可见，天天和晁盖混在一起的吴用，居然不认识
宋江！两人从来也没见过面！
所以，说宋江和晁盖是心腹弟兄，就很令人怀疑。
话再说回来，即使真的是心腹弟兄，在生死关头，也没几个人舍得抛弃自己的前途
与性命去通知人家逃跑的。
可见，里面还有文章。下面，是我的一己之见：
（一）高收益
无论宋江报不报信，晁盖逃走的可能性，都非常大！
我们假如宋江不去通风报信，那么，接着，必然就是时文彬县令安排朱仝、雷横这
两个刑侦队长去抓晁盖。
而朱仝、雷横这两人，都是有心要故意放走晁盖的人。结果，还是捉不住晁盖！
所以，宋江抢先去报信，其本质，只是一次“投机”行为！和义气的关系反倒不怎么大
了。
这样，宋江可以在江湖上轻易获得“讲义气”好名声的机会。并且，还有望因为“
义气”而分到“生辰纲”赃物十分之一的巨款！（约人民币300万）
（二）低风险
宋江只是县里的一个小吏。何涛到县里来，是来找县令时文彬先生的，不是来找宋
江的，他遇到宋江，纯粹是偶遇。
因此，本县与该案有干系的人，是时文彬先生。
无论晁盖是跑了，还是被捉住了，其实和宋江的关系都不大。（该案不归宋江负责
）。而是和时文彬先生关系重大。
所以，晁盖如果逃跑了，该时文彬先生负全责，根本就不会追究到宋江身上！宋江
和这个案子是没有任何关系滴！
宋江偷偷地跑去通风报信，叫晁盖快跑，他是不用负法律责任的。根本就没他说的
“冒死”那么严重。
（三）除绊脚石
宋江这个小吏，相当现在一个小科长，是个注定没有前途的行业。按当时的制度，
他是没有机会做官的。但是他仗义疏财，挥金如土。这个小科长的收入就有些不明不白
了。
《水浒传》第十三回结尾写：
且说山东济州郓城县新到任一个知县，姓时名文彬，当日升厅公座，但见：为官清
正，作事廉明。每怀恻隐之心，常有仁慈之念。争田夺地，辩曲直而后施行；斗殴相争
，分轻重方才决断。闲暇抚琴会客，也应分理民情。虽然县治宰臣官，果是一方民父母。

23. 晁盖相信宋江吗？
当时，宋江骑着快马赶来给晁盖通风报信。来到晁盖庄上，庄客进去通报。
晁盖问道：“有多少人随从着？”庄客道：“只独自一个……”
从这里我们可以看出：晁盖对宋江还是持有很强的戒备心理和警惕性的，先要问清
楚他带了几个人来。并不是嘴上说的“心腹弟兄”那样放心。
上回我们说了，晁盖和宋江之间，实际上，就只是“认得”而已，谈不上有什么深
厚交情。因为天天和晁盖混在一起的吴用，居然不认识宋江！两人从来也没见过面！
现在，宋江进来了，说道：
“哥哥不知，兄弟是心腹弟兄，我舍着条性命来救你。如今黄泥冈事发了。白胜已
自拿在济州大牢里了。供出你等六人……‘三十六计，走为上计。’若不快走时，更待

先夸自己的功劳，“我舍着条性命来救你”。再讲你现在出了事，你应该快点跑。
更有趣的是，真正的心腹弟兄，是不会挂在嘴上念的。而宋江一进门，开口第一句
话就说：“哥哥不知，兄弟是心腹弟兄”。
宋江都说完了，晁盖却未必相信。
姓宋的，你小子该不是在诈我吧。
哦，你叫我跑，我就跑？我有那么傻吗？！我一跑，不就是不打自招吗？哼哼，我
晁盖怎么会中你这个黑押司的圈套呢？
姓宋的，你小子该不是也想浑水摸鱼，分一杯“生辰纲”的羹吧？再说了，我抢的
那几个担子，是“生辰纲”吗？里面也没几个钱呀。
哼哼，想诈老子，没门！
老子就不跑。
事实上，晁盖本人，当时听了宋江的话之后，并没有跑。我们来看：
宋江回去后，装模做样地对县令向前禀报。
知县看了公文，大惊道：“这是太师府差干办来，立等要回话的勾当。这一干贼，

知县大人正要马上去捉。宋江道：“日间去，只怕走了消息。只可差人就夜去捉拿

宋江叫夜里去捉，明显是在故意拖延时间，好让晁盖有充分的时间逃脱。
应该说，当时就去捉，即使有人报信，消息泄露的速度也不会比缉捕人员快。因为
到晁盖庄上，不需半个时辰。并且，大白天肯定要比夜里更容易抓捕。
下面，我们就来算一算这个时间差：
宋江跑去报信的时间，是巳牌时分，上午9点钟，知县退了早衙，大家吃早饭的时
候。而朱仝、雷横两个缉捕队长去抓晁盖的时间是夜里一更天气，黑定了。
中间有至少12个小时的时间。
晁盖如果是相信宋江的，那早就跑的没人影了。
无论如何，晁盖不至于呆12个小时还不跑！朱仝、雷横夜里来的时候，晁盖根本就
不应该还呆在家里！！！
这个晁盖，大大的狡猾，多疑，他先叫其他几个人转移了，自己却呆在家里观望：
如果宋江说的是真的，他再走不迟，
如果宋江说的是假的，他就完全没必要跑了。
结果，朱仝、雷横来的时候，庄客们看见，来报与晁盖说道：“官军到了，事不宜
迟。”
晁盖就放火烧了房子，跑了。
事实证明，宋江说的是真的。那么，晁盖真的会感激宋江吗？又会怎样报答宋江呢？
“生辰纲”被劫之后，上级官府差人去济州下公文，限期济州市长十天之内破案，
若十天之内破不了案，就要“请”他到沙门岛走一遭。（流放）
府尹大惊，马上把公安局长何涛叫来，大骂一顿，说他不用心缉捕，恐吓道：“先
把你这厮迭配远恶军州，雁飞不到去处。”便唤过文笔匠来，去何涛脸上刺下“迭配..
.州”字样，空着发配州名。喝道：“何涛，你若获不得贼人，重罪决不饶恕。”
何涛四处打探消息，终于捕获了白日鼠白胜。白胜交代了犯罪经过，把晁盖供出来
了：“郓城县东溪村晁保正。”
于是，何涛便去郓城县捉晁盖。
这一次抓捕行动是非常秘密的。先是“三更”时分，抓住白胜，逼出口供，然后，
“星夜”来到郓城县。
按说，是不会走漏消息的。
那何涛来到郓城县县衙门口。只见县里走出一个吏员来——这个人，便是宋江。
这是宋江第一次出场，在小说的第十八回：
那押司姓宋名江，表字公明，排行第三，祖居郓城县宋家村人氏。为他面黑身矮，
人都唤他做黑宋江。又且于家大孝，为人仗义疏财，人皆称他做孝义黑三郎。……平生
只好结识江湖上好汉。
当时，宋江见了何涛，问：上司到弊县来，不知有何公务？
何涛就把来捉晁盖的事都说了。
宋江听罢，吃了一惊，肚里寻思：“晁盖是我心腹弟兄。他如今犯了迷天之罪，我
不救他时，捕获将去，性命便休了。”然后，畔住何涛喝茶，自己转身就去给晁盖报信
，叫他快跑！
那么，宋江为什么要私放晁盖呢？
仅凭“心腹弟兄”是说不通的。虽然嘴上说的是“心腹弟兄”，但实际上，仅仅就
只是“认得”而已。也谈不上有什么深厚交情。
1. 晁盖七人聚在一起密谋“生辰纲”时，从头到尾，压根就从来没提到过还有宋
江这个心腹弟兄。
2. 晁盖天天和吴用聚在一起商量，这两个才是走的最近的人！关系不是一般的密
切！
3. 吴用却问道：“正是谁人？”可见，天天和晁盖混在一起的吴用，居然不认识
宋江！两人从来也没见过面！
所以，说宋江和晁盖是心腹弟兄，就很令人怀疑。
话再说回来，即使真的是心腹弟兄，在生死关头，也没几个人舍得抛弃自己的前途
与性命去通知人家逃跑的。
可见，里面还有文章。下面，是我的一己之见：
（一）高收益
无论宋江报不报信，晁盖逃走的可能性，都非常大！
我们假如宋江不去通风报信，那么，接着，必然就是时文彬县令安排朱仝、雷横这
两个刑侦队长去抓晁盖。
而朱仝、雷横这两人，都是有心要故意放走晁盖的人。结果，还是捉不住晁盖！
所以，宋江抢先去报信，其本质，只是一次“投机”行为！和义气的关系反倒不怎么大
了。
这样，宋江可以在江湖上轻易获得“讲义气”好名声的机会。并且，还有望因为“
义气”而分到“生辰纲”赃物十分之一的巨款！（约人民币300万）
（二）低风险
宋江只是县里的一个小吏。何涛到县里来，是来找县令时文彬先生的，不是来找宋
江的，他遇到宋江，纯粹是偶遇。
因此，本县与该案有干系的人，是时文彬先生。
无论晁盖是跑了，还是被捉住了，其实和宋江的关系都不大。（该案不归宋江负责
）。而是和时文彬先生关系重大。
所以，晁盖如果逃跑了，该时文彬先生负全责，根本就不会追究到宋江身上！宋江
和这个案子是没有任何关系滴！
宋江偷偷地跑去通风报信，叫晁盖快跑，他是不用负法律责任的。根本就没他说的
“冒死”那么严重。
（三）除绊脚石
宋江这个小吏，相当现在一个小科长，是个注定没有前途的行业。按当时的制度，
他是没有机会做官的。但是他仗义疏财，挥金如土。这个小科长的收入就有些不明不白
了。
《水浒传》第十三回结尾写：
且说山东济州郓城县新到任一个知县，姓时名文彬，当日升厅公座，但见：为官清
正，作事廉明。每怀恻隐之心，常有仁慈之念。争田夺地，辩曲直而后施行；斗殴相争
，分轻重方才决断。闲暇抚琴会客，也应分理民情。虽然县治宰臣官，果是一方民父母。

放弃新申请。
2类、如果是列举的签证类型、移民局允许没有AP离境。所以不必在境内申请AP。申请
没批之前也可以离境。

1）不允许有移民倾向的身份F、J等：

。否则这个在境外递交的申请只是个摆设、没有任何意义。

你关于H /L 身份 AP使用的结论是不对的，请仔细解读原条文以免误导他人。
对于H/L只是说，在拿到AP之前，你可以离开，485和AP申请不会被视为放弃。 当你回
来的时候，允许你用H/L签证入境， 而不是刚批的寄出的AP。AP如果在有效期内，可以
在下次入境的时候使用， 这一点跟持F/J/B签证的不同。对H/L以外的身份，只有等到
AP批了才有效，AP未批离境，485 和AP的申请视为放弃。

你贴的规定里明确要求了两种情况，一种是拿着AP出AP回，另一种是re-admitted as H
-1...才不视作abandoment of I-131 application

我怎么从#2 得不出你的结论？
AP 不是invalid，但是前提你得用same H/L/K/V签证入关啊。
上次我问过NSC 管combo card的人， 她说AP批复之前持H签证离境，离境期间AP批了（
因为USCIS不知道你离境，会继续批131），如果寄AP回国，能否入关看海关是否准许。
我认为renew 也是适用这个--看海关。

AP 不是invalid，但是前提你得用same H/L/K/V签证入关啊。
上次我问过NSC 管combo card的人， 她说AP批复之前持H签证离境，离境期间AP批了（
因为USCIS不知道你离境，会继续批131），如果寄AP回国，能否入关看海关是否准许。
我认为renew 也是适用这个--看海关。

interpretation on Advance Paroles. This interpretation will help those who

As regular readers of MurthyDotCom and the MURTHYBULLETIN are aware,
the American Immigration Lawyers Association (AILA) periodically holds
teleconferences with various USCIS officials regarding procedural and
legal matters. On March 29, 2004, there was a teleconference with Service
Center Operations that provided some helpful information regarding
advance parole. The issue was raised regarding travel while an Advance
Parole is pending. Specifically, it was noted that the Form I-131
instructions state that travel outside of the U.S. before the advance parole
document is issued will result in abandonment of the I-131 application.
The AILA Liaison members requested a clarification to assure that this
advisement did not apply universally. The question was whether the
limitation applied to persons who have a previously approved advance parole
prior to departure and for those with pending I-485s traveling in H1B,
H-4, L-1, L-2, K-3, K-4, V-2 or V-3 categories. The short answer is that
the limitation does not apply to these categories, provided the
approved advance parole or above-listed status does not expire while the
person is outside the United States.
Previously Approved Advance Parole
====================================
The USCIS stated that if a person has an advance parole and applies for
a new advance parole while in the United States, s/he may travel and
reenter the U.S. using the already approved advance parole. The person
must return during the time period permitted under that advance parole
that was approved before the person's departure. The USCIS specified that
the person cannot remain abroad after the expiration of the first
advance parole and then seek to enter on the second one after it is
approved.
Case Example with Dates
==========================
A person has an advance parole that is valid through June 15, 2004.
S/He files for a new advance parole on April 15, 2004, while in the U.S.
On April 20, 2004, the person learns that s/he must travel abroad
immediately. Under the USCIS advisement, the person could leave the U.S. and
reenter on the first advance parole through the June 15, 2004 date. The
advance parole filed on April 15, 2004 will be valid once it is
adjudicated for travel from its approval through its validity date.
It would not be permissible for the person in the example above to
depart the United States on April 20, 2004 and remain abroad past June 15,
2004, waiting for the second advance parole in order to reenter the
U.S. The person could not have someone send him/her the April 15th advance
parole in August 2004 and use it for reentry.

刚得到公司律师的回复，不知道他说的是不是绝对正确，我这种情况申请VISA似乎是唯
一稳妥的途径。

If you read the rules in case a), b) and the following paragraph, it is
clear that if you want to come back during 485 pending, on the day you enter
US, you have to meet either of conditions below
1)valid H/L visa (you can get it only if your H/L doesn't expire)
or
2)approved AP. it is the one you get before your departure, not the one
approved during the period out of US. in case a) it clearly says you have to
leave and enter during the approved period of a previously approved AP if
you want to use AP to enter.
So my answers to your questions are

但是我没有看到任何地方说HLKV不能用新AP入境。
有个问题：以前批的EAD/AP，生效日期从批卡之日算。据前段时间说的，combo卡是按
