麻烦问一下
我的绿卡排期到了递交了485
如果我在485批准之前结婚
但是LD暂时在国内不想递交485
这种情况下
是不是只要我的485批准了
那么他就不能在申请了
还是可以按照follow to join
以后他什么时候申请都可以按照我的PD来批绿卡呢？
如果不是的话
是不是如果我的485批准了
他却没有申请
他连B2都没有可能申请到了呢?

I want to transferring from EB3 to EB2 NIW after May 1, but I do not have
EB3 I-140 approval notice (Company's attorney did not give me a copy).
Through FOIA, it will take very long.
What did I need to do?
can I request transfering without copy of EB3 I140 aprroval?
now I have EB3 I485 receipt which indicates PD earlier than EB2 PD in I140
approval notice. Can USCIS officers check my EB3 I-140 in his system based
on info in EB3 i-485 receipt?

把你的A#和140 receipt # 提供给USCIS。

如果结婚在485批准前，只要排期不后退，他随时可以在国内通过领馆办，据说处理时
间比交485长。

I did not have I-140 receipt #, because I have not received this receipt
notice. I think that all mails about I140 went to my company's attorney.

他反正几年之内也不打算来的，那是不是follow to join没有时间限制的呢？
比如我明年拿到绿卡了，他哪怕5年以后申请也可以是吗？

I guess I misunderstand your question before.
see if I am right
What you want is "PD porting" or "PD retention", aka, using your EB3 PD for
your NIW case.
I didn't do any of that before, but I think you can google that for many
cases.
I am guessing you can do it now, as the PD can be on your 140 (NIW). And if
you you have that early PD on your NIW, you can start asking to relink your
I-485 to NIW 140 (with early PD already)
You may be able to do that in one step too next month, I am just not so sure
about that.
But first, try to understand PD porting or retention

哦大概多久呢？那这个期间是不是可以用H4入境呢？
我google了很多说大使馆可以发移民签证到底指的是什么移民签证呢？
他现在来美国看我都是B2，那如果我们现在结婚了，他是不是可以回去申请一个H4签证
以后就用H4签证入境每年renew就好了。。。。。？

Thanks for your reply.
I have two approved I140s from EB3 and EB2 NIW, respectively, and have
submitted I-485 with pending status based on EB3.
You are right that I want to use my EB3 PD (April, 2012) for my EB2 NIW case
with PD: (Dec. 2012), because EB2 is current next month.
I just want to do something to tell USCIS officer that using EB3 PD can make
me greened.
Any further comments? Sorry I am poor on green card knowledge, so I really
need your advice. Maybe this process does not belong to transferring.

不好意思还有个问题就是如果我的绿卡批了我就quit了工作，他还能申请吗？
