XXX would not be able to file the I-140 with Premium Processing. The current
processing time for an I-140 at the Texas Service Center is four months.
Many things can change with the visa bulletin during this period of time.
If XXX were to apply to down-grade YYY’s employment classification to EB-3,
YYY would then need to request the USICS to transfer the new I-140 to YYY's
pending adjustment of status application. The priority date for the EB-3
visa petition must be current in order to apply it to YYY’s adjustment of
status. So potentially, if EB-3 is not current when it comes time to link
the new I-140 to YYY’s AOS, YYY will have to wait for EB-3 to become
current to request that the new I-140 be linked to YYY’s AOS (which can be
a timely process in and of itself).
Given the cost and complexity of down-grading to EB-3, it is likely that it
will be more time and cost effective to remain in the EB-2 category and
extend YYY’s current Employment Authorization Document as necessary.
