In California, vehicular manslaughter requires that the perpetrator have a "
grossly negligent" state of mind.
Someone is "grossly negligent" if they knowingly disregard the safety of
others.
郭红这个case蛮简单的。
如果郭是在单行道从右侧超车，那么是“grossly negligent。”
如果郭是超速，那么是“grossly negligent。”
如果郭是在打电话，那么是“grossly negligent。”
如果郭全神贯注，低于限速正常驾驶，看到自行车后及时刹车，尽了最大努力避免事故
发生，那么郭不但无罪，还可以起诉加州政府。这是加州政府的责任。

补充一点，vehicular manslaughter 有四类。
DA起诉的罪名是根据 PC 192(c)(1)。判决有罪的话，郭红要在州监狱呆2，4，或6年。
PC 191.5: Vehicular manslaughter while intoxicated, with gross
negligence. Penalty: Up to 1 year county jail, or 4,6 or 10 years state
prison. Note: With one or more priors of this or certain other vehicular
felonies, 15 years to life in state prison ("Courtney's Law").

intoxication. Penalty: Up to 1 year county jail, or 2,4, or 6

主要是jail和prison的区别
Jail：等待判决的疑犯（比如郭红），或者轻罪罪犯（比如给20岁的mm买酒）
Prison：重罪罪犯（比如和16岁的mm困觉）
