485 副申请人利用已批准的combo卡明日出境美国回中国。combo卡2017年10月到期。主
申请人想在接下来一两周内把renew的材料提交。这样副卡回来的时候（计划9月初用现
在还有效的combo卡回来），新的卡估计能够续得上。
问题是：副申请人能否在离境期间由主申请人提交renew的申请呢（假设副申请人离境
前已经给表格签好字了）？还是必须要等本人回来才能递renew的申请？
多谢过来人解答一下疑惑。

他自己是做那种线上推广的。然后办公室因为是做美妆的全是姑娘。恨不得男的就那么
几个全都是女的的那种公司类型。反正其他的部门也有男的，但是大多外勤，在办公室
他属于常驻所以过不下去了。
以为自己是进了天堂，其实都是地狱。国内办公室的那个位置有的是小区里。就一个卫
生间。就一般女的还磨叽。所以他就成了唯一一个尽量不上厕所或者去也得跟另外一个
男的去的那种。感觉特别小姑娘的那种。还得关敌料阵的那种。那个厕所门一度是坏的
，就只能跟其他的男同事一起去上厕所。
然后就是他属于那种重灾区。就属于什么事情都是他的。重活脏活和累活只要有就是他
一个人的。能者多劳。还得什么都做。说好端端的线上运营都给锻炼成线下地推了。
还有就是女的八卦最多了。今天和谁明天和谁的。弄的他也没话可说。要是不说就好似
你不团结。一群人心怀鬼胎的还得一起出去玩，说着恭维上司的话其实都背后骂他傻逼
。但是谁也不敢说。就他最后受不了就走了。
感觉还是要找个工作里的男女比例差不多的地方。面试的时候自己注意点。更要不这样
就真的是只能当做笑话看了，哭笑不得的。

你仔细阅读以下ADDENDUM V里的规定如下：
Advance Parole Pending - Travel During. The new 1-131 instructions say: “If
you travel before the advance parole document is issued, your application
will be deemed abandoned if (1) you depart from the United States.” We
would like to confirm that abandonment of a pending advance parole
application does not occur if the foreign national is otherwise authorized
to depart and return either because the foreign national (a) already
possesses a valid I-512L and returns before the 1-512L expires, or (b) has
an 1-485 pending and is re-admitted as an H-1, H-4, L-1, L-2, K-3, K-4, V-2,
or V-3.
USCIS: (a) If a foreign national (i) already possesses a valid, unexpired
advance parole, (ii) applies for a new advance parole while he/she is
present in the U.S., and (iii) then departs the U.S., the foreign national
must return to the U.S. during the validity period of the current advance
parole already in his or her possession. If the foreign national returns
timely, abandonment of the pending advance parole application would not
occur. However, the foreign national may not remain abroad after the initial
advance parole expires and then seek to re-enter at a later time using the
subsequent advance parole that was pending adjudication at the time the
person departed the U.S.

Addendum (ii) 里难道不是说的新的AP需要提交之后也就是pending状态才能出境吗？
我知道131的表里可以选AP寄到国外的大使馆，当申请人在国外的时候。可是出境难道
不应该是在新AP提交申请之后？
迷糊了，请达人们指正。

律师告诉我，绝对不可以。我的情况和你类似。提交到pending之前人必须
physical 在美国境内。如果pending后离境必须有合理的手续（准许移民类签证，非
移民签证不可以）。否则，就是自动放弃。

再看了一下，好像正常的AP是不能在境外申请的；只有很特殊的情况下才能在境外申请
AP。看第26项（在第9页）：
Advance parole granted to those outside the U.S. is an extraordinary measure
used sparingly to bring an otherwise inadmissible alien to the U.S. for a
temporary period due to a compelling emergency or significant public benefit
. It is not to be used to circumvent the normal visa issuance process.
Advance parole that is sought to preserve the pendency of an I-485
application must be applied for and granted before the alien’s departure
from the U.S.
但是Addendum V说可以的是在境内递交renewal，跟着在pending期间离境，在旧AP过期
前回来，那新的AP批了之后可以用。就是说，递交时要在美国，但是pending期间可以
离境，不会影响新的AP的处理。

换个思路这么想，只要楼主在AP有效期间返回美国，那么renew的材料就可以成立，即
使不成立，也不可能影响他的合法返回。
大前提就是必须在旧的AP有效期回美。这个是绝对绝对不能出错的地方。

看了大家的回帖，问题在于如何界定怎样才算是认定application pending了-- 是提交
了就算呢，还是要等拿到收据才算呢？
领导今天就走了，没时间再琢磨了，保险起见，先办工卡更新吧，ap 等回来再说吧。
