My two cents:
1. It is very wrong for parents to discard their own kids, even temporarily.
There is no excuse, no matter how poor they are, how many difficulties they
have, except that they have psycho problems.
2. If the American family have cared the girl since she was a little baby,
with sleep deprivation, endless feeding and diaper changing, they are tightly
bonded with her and will not want to separate from her, no wonder they fighted
so as not to return her to her cold parents.

I have to disagree with the lawyers here. Is there any conflict between
emotion and law? In custody cases, emotional attachment is an important issue
to consider. Natural parents have the priority. The U.S.Supreme Court has held
that parents have the consitutional rights to their children's upbringing.
I found the court is very wrong to consider the "best interest" of the child
first. Ohterwise, we get an absurd result that the court should order
hospitals to give away newly-born babies of poor

Of course there is emotional tie - the baby's been with his/her parents
for 10 months already. Anybody with children will tell you that. When my
daughter was born, she was not a stranger to me. I feel I've known some
of her personalities already.

I have been a CASA to advocate for abused and neglected children for
a while. When considering "best interest"of the child, the court
considers a lot of issues. Finance issue is just one of them.
Social workers, advocates will talk to the child at a regular
basis to know what the child is really thinking about. DCFS
(department of child and family services) will also try their
best to get the child back to their parents. The decision of
the court might not be perfect, but it is no way as absurd

There is no abuse involved here. What I am claiming is that the court should
first consider whether the parents have abandoned or done anything with the
child. Then the court can consider the best interest of the child, i.e. who
should the child live with.
I have followed this case for a while. The first judge excuded himself for
possible bias after dragging this case longer than the statutory limit of 2
years.
I may not know the family law that much since I have never worked in that
area. I cer

do you guys think that the child was abandoned if the parents refused to take
the child back after 3 months of free care by that american couple, using the
absurd reason of "there's some friend living with them in their apt., so
there's no room for the child"
seems to me that's abandon.

Not to mention that during the peak of discord over Hes' parental
visit, Bakers called the police, who warned He to stay away from
the Bakers home. Fearful of further trouble with the law, He
complied. But what he did not know was that under TN law, a four-month
lapse in visits can be construed as abandonment.
