我是在某个校理科系读书。在今年春季的时候，有三天连续失眠，无法入睡，入院治疗
一周。可能的疾病属于disability范畴。
在这之前，工作生活算是还可以，人际关系属于非常良好。生病前没有任何工作中的问
题。每周为老板做牛做马75小时以上。
在我出院回来的一周内，我与老板有几次交谈或交涉。然后迅速收到其email，称我不
适合在这个实验室工作，而且称这个决定是他在我生病之前做出的。他说我应该另找
lab，下个学期不会再雇我工作。
其后心态很差，精神状况非常不稳定。当然还是与老板，系里，学校持续交涉。目前是
休学一年。想请教我应该怎样最大程度保护我的利益。真诚求教，真心谢谢各位。

1. Are you an employee or just a student?
2. If the university did not dismiss you, you are not discriminated by the
university.
3. The professor could request you to leave as long as he has some
legitimate reason. A court probably will not infringe on a professor's
academic freedom to choose his own student.
4. I don't think you can sue the professor for damages since he has no legal
duty to take you as his student. If he did breach some contract with you,
you might be able to sue.

我只是graduate.
感谢你的回复。现在才知道在美国学习有多不容易。感觉投入的青春就这么作废了，呵
呵。只能说，很多东西只能压在你选择的老板的人品和性格上了。非常谢谢你的专业意
见。

Usually you can get some legal advice from your school. There should be a
student legal office.
The final solution is go to the court....Do some research and negotiate with
your department and school. Probably you can ask sometime off and then come
back.
Your health is your priority. 留得青山在，不怕没柴烧。
