我们想找个人回国工作
具体请参考我的贴子
职位：市场总监也可以叫运营总监
目前深圳有50人左右美国san jose有4人
运作模式，在深圳操作EBAY AMAZON 零售网站批发网站等销售渠道，在美国发货
在这些销售成熟后，开始将公司运营平台化，作为中国商品送达美欧消费者的一个平台。
工作分三个阶段前三个月为试用期如果合格三个月后有利润分成
如果工作出色一年后可以入股
工作地点在深圳薪水 20-50万人民币 + 分红
要求：
1、丰富的销售网站策划和运作经验，有成功案例；
2、对互联网有深入了解，较丰富的产品运营经验，有良好的市场开发和营销能力；
3、熟悉电子商务网站结构及运作模式，能够熟练运用多种营销手段；
4、能够规划管理电子商务相关的业务流程；
5、沟通表达能力强，优秀的创新能力和沟通协调能力、良好的逻辑分析能力，并具有
敏锐的市场感知力；
6、有创业精神，较强的客观分析能力，优秀的团队领导能力；
7、本科以上学历，硕士以上优先，计算机、工程、工商管理、电子商务及信息管理、
市场营销等相关专业；
8、良好的英文口语及书写能力，能用英语进行工作

一位加州的朋友问我的问题，我没有这方面的经验也不敢贸然回答，希望这里那位大侠
能帮忙解答一下：
朋友刚刚从一家生物公司跳槽，现在想和几个人回国搞一个类似的生物公司在中国市场
做同样的产品。但是她担心跳槽前（或是受雇时）同公司签的合同中的anti-compete
clause，她的前公司是否会以此将她告上法庭呢？
我google了一下，似乎加州是唯一不enforce anti-compete clause的州，除非一些例
外情况，例如保护商业机密。不知道这家生物公司的技术（blood screening）能否算
做商业机密？那家公司能否以泄漏商业机密罪起诉她？

I don't think you can find any job related to radar here. Lincoln Lab is a
perfect place for radar design.

The old company may have a case. But covenants not to compete must be
limited, among other things, geographical scope. If her old company's
business is limited to U.S., her new company is limited to the Chinese
market, and there's proof that the old company will not enter the Chinese
market in the future, that may be a viable defense.

So, do you suggest me to take plasma physics? Is that helpful for job-

I thought I could learn something about antenna with radar design.

Thank you for the response post. That's a great point. Her old company is
not doing business in China at the moment, although it does in Japan.
Do you have any thoughts on the case of trade secret appropriation?

我倒是建议你去学radar design,你可以学到一些系统级的东西，从power
transmission
到signal process，学点皮毛也很好。对EE这个整体概念很有些用
plamas physics主要是正负电子的运动，分布，等等，几乎p用没有。

In that case, the old company may make a good argument that restricting your
friend's activities in China is reasonable.
I do not know enough facts to tell you which way this case will go,
including answering your question on trade secret misappropriation. In any
case, I do not feel comfortable rendering a detailed legal opinion online.
You should talk to a lawyer in the real world if you want to stay out of trouble.

Non-complete clause is unenforceable in California because it violates the
state's public policy. Period.
But your friend's former employer could sue hin in other jurisdiction or on
other grounds such as misappropriation of trade secrets or breach of duty of
loyalty depending on the facts of the case. If he is serious about
starting a company in China and getting into U.S. market, he should have
retained a legal counsel anyway.
