Bought house at 565K with 150K downpay.
Now house value is 310k, loan 405k.
somebody said I could pay 5k to hire an attorney to force the bank to drop
the loan to decent amount due to my 26% downpayment.
true or false?

The only thing you need to consider is your credit vs $95K. You need no
attorney.

you can let bank agree to a short sale, and you (or your friend) can buy
back later.

walk away like most americans do. make sure you have a stable job though as
bad credit may be problematic when looking for a new job.

credit好像7年有效，平均一年1.5w，您的什么credit值1.5w?
如果under water 10w以上，毫无疑问，just walk away. 更加好的事情是现在bank
已经没有时间foreclose了，你可以继续住在里面一年以上，并且慢慢把房子里面的
东西搬/偷走（比如吊灯，瓷砖，洗衣机，热水器，各种铜管，花岗岩，bath tub，
甚至樱桃木柜子等等），大约又可以节省一年3w的房租，和价值大约1-5w的战略物
资。

look up loan modification
if no help, short sale, foreclose are your options. you'll save a ton of
money by forclosing if you don't care about your credit for a few years.

如果打算7年不买房，也不需要申请其他信用/贷款，可行。

it is rental house, no way for loan modification.
I did moved back and tried modification with bank, it cost me $500 for
apraisal and failed.

if the rent can cover most of your expenses, then just think of it as
spending small money to buy a house in 30 years ba.
