简要介绍一下事情经过:
公寓水管年久失修,漏水把地板淹坏了. 房东自己出钱修水管,但是让我出部分跟换地板
相关的费用,我的bill是$1000.
因为漏水水管在柜门里面,我们几乎不打开柜门, 所以看不到也没听到. 水从木地板下
面蔓延,把厨房和餐厅的10多块木地板搞得轻微变形了.
下班回家发现地板有些变型,并联想起来2天前开始看到少量的水从厨房和客厅地板间缝
隙(基本都发生在是在吃完晚饭用过刷碗机后).裂了的下水管是和洗菜池和刷碗机连得.
怀疑漏水, 马上告诉房东,在她的指挥下打开柜门,看到漏了的下水管.
他让我付$1000,因为嫌我告诉她太晚了,造成了地板变型. 但是除非有过类似经历的人,
换了谁也不能在地板没变形的情况下想到,那么一点水是漏水造成的.下水管的柜门和厨
房饭厅交接(也就是有水渗出来的地方)距离很远. 因此我觉得我不应该负担费用.
根据以前网友的建议,我没有给钱,并告诉他我不负责.

更新内容:
房东来email说7天之内要给钱,否则:
1. doubling the security deposit,
2. conducting unannounced inspections
3. and/or start eviction proceeding.
4. You will be held accountable for all costs and legal fees.

我的问题:
1.是不是last month rent应当算成deposit的一部分? 签合同时候被要求入住前交
first month rent, last month rent, 和security deposit. 问这个因为马里兰州规
定deposit不能超过2个月的租金. 如果last month rent算,他就不能再涨deposit.
2."conducting unannounced inspections" 是不是法律允许? 合同里说只有emergency
情况他们才能进来检查. 如果他总是不经允许进入我家,我应该怎么取证? 应该怎么保
护自己的利益?
3. 如果她"start eviction proceeding", 我应该怎么做?
4. 我在他手里押金是两个月的押金,他一般发难都是月初才拿到新租金时候,这样他手
里有3个月的押金 $5250. 他说扣这个扣那个钱,我怎么要回来,或者避免她赖账?
5. 他说我们造成了很多damage,迟早要我们自己花钱修. 入住的时候就有很多问题,因
为都是小问题,我只和他用email讲了两个.他没给修,我也没太在意. 入住后的所有新问
题都report给他了,也都修了.
入住的时候没有拿到list of damage的表格,所以也没有填写. 当时他没有给我那个表
格,也没有告诉我,我有权利索取那个表格.现在除了这个情况,我怎么保护自己?
请大家给点建议,最好能同时给出那条法律作为依据.

1) & 4) Last month's rent IS last month's rent. 不是押金。
2）unannounced inspections 应该是不可以的。

房东不买保险么？要你赔。下水管年久失修是你的错？

I have been a landlord for some years,I fighted with all kind of tennant, I
won mostly in the court, but never got back my rent, recent one, I lost 6
months rent. now for your side, do this :
1. Keep all evidence inclduing pictures and his letters and communication
emails.
2. started to refuse pay rent!!!!
3. sent him a letter for reasons to refuse his request, and tell him you
will present in court anytime as needed. tell him his house conditons was
not suitable to living with leaking and other conditons( try to find others:
electricity, heater, refrigerator, gas, bugs,moudel....)
4. To find it's apartment or house, if it's legal for rent, if legal for
rent, to find how many units in the building, and how many family he put
totally now. for example, if it is a 3 units house, but there are 4 family
living there, you can refused to pay rent forever, simple way is: to call
city to find how many units legally, and tell city L &I ( license and
inspection) department if you find .
5. find if there is fire and emergency system, if not call city.
6 if you find anything illegally, call city L&I department,
officer will come to do inspections, they will always find something wrong,
if nothing you can find now, just tell them your apartment leaking with bad
conditons such as moudel and they will give landlord a violation
7. you can have all kind of evidence from leaking, and if he really sue you,
dont worry about it at all, you have more chance to win back. keep in mind,
don't pay rent at all, even you lose , you can pay back.
8. from beginning of eviction procedure, to the day you leave, mostly 3
month or more, landlord had more worry about all.
9. Call police anytime if something he do: shut off yor water, gas,
electricity and so on, before sherrif to take you out, you are legal
occupancy, and nobody can violate your right. it's illegal for landlor to
shut off anything for no payment reason.
when you start to creat all kind of trouble and headache, he will come to
beg you to leave even your did not pay for months.

I go to court every few months to fight tennants...
landlord is not easy at all

你这无间道当的。我也是房东。碰上无赖房客时也气得很。
不过，你这么设局让人跳，也太不地道了。将来楼主被
递解出境，你不会偷着乐吧？我的一个朋友的房客前不久
刚被递解出境。

他教人家耍的那些花招，法官一眼就看穿了。
法庭上法官天天审理这类案子。这些花招
能没见过？
我那朋友的房客就是太聪明了。结果聪明
反被聪明误。激怒法官，让法官以contempt
of court罪名先关监狱，再递解出境。

LZ 看站内信。房东有什么证据说“你们通知他晚了”？从现在开始你们就坚持说你们
第一天发现是看到地板有轻微变形-- 之前没有任何明显迹象，然后立刻就通知他了。
5. 看你的lease 上有没有说 “你检查过了一切东西都是好的”；如果没有，房东没有
道理；即使有，房东也应该要给 checklist 。有些东西要使用几天才可能知道好不好
，责任应该在房东 -- 这个是我的理解；因为如果跟公司租房子，公司都会给个
checklist 给你几天时间去看看是不是东西都好用的。你明显不可能在签约第一天就发
现所有问题。 -- 这个上了庭即使你提供不了明确证据当时什么东西是坏的，法官也未
必站在房东这边; 除了你说的两封email , 其他还有什么东西是什么时候发现坏的，什
么时候通知，什么时候房东来修，有没有修好，你最好自己做记录
另外不要太担心，比如油漆掉了门不好用之类的，属于normal wear and tear, 正常
几十年的房子老化状况，你不用负责；这个term 很popular , 随便google 一下就出来

你说的那个bill 是谁发给你的？
如果搬进去的时候没有对各个角落照相，要不就现在照吧（虽然不知道还有没有任
何用）
其他：
1. 如果你打算继续住下去，除了房租应该照付（请留你按时付房租的证据），其他
你就一概不理；跟他说他要是觉得他有道理要这笔钱就上庭好了 -- 不过要是我的话
我会想办法尽早脱离这个lease.
2. 从现在开始跟房东交流尽量保持书面；如果他有威胁性语言之类的可以留证据；
自己说话写信注意语气。
3. 如果还要住下去，发生的事情都按日期自己记录下来 ----—不然等你搬出的时
候你都不记得什么时候什么事；即使你说有法官也要问怎么那么久你还记得。

上法庭见法官最好的策略就是老老实实。
法官天天审这类案子，什么花招没见过？
有一说一，诚实才能赢得法官的同情。
法官都不傻，见这类的案子多了。
只要双方都老实，一般法官都能找出
解决办法。如果一方耍花招，让法官
认为你不诚实，肯定判决会倾向另一方。
当然，这是一般情况。不过，法官也是人。
如果法庭上有一方律师和法官熟悉有交情，
上面的法则就不适用了。在这种情况下，
一般是房东的律师和法官熟悉的可能性
比较大。毕竟房东是地头蛇，周围关系
多，为房子上法庭的机会多，认识律师
和法官的机会也多。
作为房客来说，除非你确认房东很弱，
否则最好不要耍花招。否则，聪明反被
聪明误，后悔都来不及。
从楼主的描述上看，他的房东应当不弱。
或者说，应当是相当的强。这种情况，
还指使楼主耍花招，就是让他自己找死。
所以我才说是无间道。

我发现你是这里很无耻的一个ID，我不知道你是精神分裂还是别有用心，不过你蠢是
一定了的。
首先，房客房东是民事纠纷，不可能触发刑事责任，这个你显然是不知道。
其实，移民法上的递解出境一定要刑事判决，很显然这个你也不知道。
第三，移民法的递解出境一般不适用于刑事违规（Misdemeanor），需要一年以上的刑
期，这个你也不知道的哦。
你这种又蠢，又无耻的东西，最好少出现，姐见一次打一次。

if u refuse to pay rent, landlord can use 7 day eviction notice to evict you
. He may lose one month rent but u get one eviction record. After the
eviction, judge will still order you to pay for the time u live there.
Repairment fee is another story.

1.狗狗了一下：Contempt of court is a court order which, in the context of a
court trial or hearing, declares a person or organization to have disobeyed
or been disrespectful of the court's authority.

狗狗完了有两点感想：
(1)说法官会因为私人关系判案，是确定无疑的disrespectful of the court's
authority，是很好的Contempt of court实例，或许更严重：涉嫌诽谤美国的所有法官。
(2)楼主的帖子和so far的回帖都没有计划或建议to have disobeyed or been
disrespectful of the court's authority。即使有的建议不好，需要争议，例如：不
付房租，那也和Contempt of court没有任何关系。
2.递解出境的前提是犯罪，还必须是重罪。

3.楼主的案子是民事纠纷，而且楼主还有理。
4.如果“我有一个朋友没有被递解出境”，原因不是因为他是我的朋友，是因为他没有
犯需要递解出境的罪。如果“我有一个朋友被递解出境了”，原因也不是因为他是我的
朋友，是因为他犯了需要递解出境的罪。“朋友”两个字换成“房客”也成立。
5.谁给律师钱律师为谁服务。房东能雇的律师，房客也能雇。房东的律师或房客的律师
和法官有关系的概率各自50%。况且，在中国，如果律师和法官有关系，对官司有利，
但这里是美国。

法庭一般会帮房客，而不是地主。
如果不是恶意欺骗法庭，没有理由会触犯法律。恶意欺骗，讹诈除外。

最近一直特别忙，没有看bbs。看到这么好心人多建议，非常感动！
我不会开车，所以可以租住房子很有限。现在这个房子，条件不好，但是也算矬子里面
拔将军了。而且一年多以后不知道搬到哪里（换城市换省换国家），所以这么点时间能
不折腾搬家就不想折腾。
按照大家的建议，我决定继续付房租，拒绝不合理账单，准备和房东上法庭。

这个贴太强了，收藏了。
现在作为房客，我可以知道怎么保护自己。
以后我作房东，也可以知道那些事情非法，不要做。
如果有可能，我还想继续住下去，1年多以后又要换地方（城市省或者国家），现在还
拖家带口的，所以期间如果可能就不想折腾了。所以我决定规规矩矩交房租。其他事情
他欺负我就打官司。
最有用的一条是，打官司要花3个月，所以他扣我3个月的房租我也不怕了。这样可以放
心的规规矩矩交房租了。
