Hi, we made an offer days ago and the agent required us to sign the
exclusive buyer agent contract. we declined. And agent said she will not
turn in the offer without that form signed. We back and forth couple of
times, and the final argument from her is that if we didn't sign the
exclusive buyer agent contract, then she will not get the 3% commission.
I looked over these two document, and notice that offer itself didn't
mention 3% commission, but exclusive buyer agent contract does mention it.
I am not going to sign it. But I wonder how the buyer agent get her entitled
3% commission if deal go through theoretically?

commission has nothing to do with exclusive agreement, at least it's the
case in California.

Here in MD, the EA must be signed with offer. Otherwise, you agent cannot
get the commission.

在加州,有agency disclosure,如果你买到了房子,agent就会拿到commission的.
