律师居然还是建议我同时File EB3 I-140 和485。大家看看下面律师说的有没有道理。
我有点不明白的是，如果File EB3 I-140，那么是不是必须等到140批了，才会考虑处
理485？
在EB2排期不退的情况下，也就是始终current的情况下，是不是直接File EB2 485 比
File EB3 140+485更快呢？
希望班上的tx提提大家的想法,看看是否按照律师说的做更快一点。
这是律师的答复:
While it is possible to file the AOS and I-140 petitions according to your
preference, please note that based on Visa Bulletin trends, the EB-2
priority dates will most likely retrogress some time after the AOS
application is filed. Thus, the most likely scenario is that the EB-3
priority date will be current faster than the EB-2 priority date at the time
the AOS application is filed. As such, by holding off on filing the EB-3 I
-140, the total time that it will take for you to get your green card will
only get longer.
Our recommendation is still to continue to proceed with the EB-3 petition
filing as this is the best strategy for helping you get your green card
faster. Since your manager has already approved of filing the EB-3
downgrade petition, we will move forward with the EB-3 petition filing.
Please note that we will be filing the AOS together with the EB-2 I-140
approval as well so that USCIS will have both the EB-2 and EB-3 petitions on
file. Please also note that the AOS applications are currently taking
approximately 12 months to adjudicate, so the EB-3 I-140 should be approved
before USCIS will start processing the AOS application.
