我们律师告诉我们, Title company # 1 认为不是什么问题, Title company # 2 认为
有问题, 需要seller弄到一个deed. 律师说她自己也不认为是什么大问题, 卖方律师
也不认为是什么大问题. 但要我们自己拿主意. 如果我们也认为问题不大, 就close
with Title company # 1, 但也不能保证以后卖房子时100%不出现问题; 如果我们认
为有问题, 要求seller把title弄clean, 可能要花几个月, seller也要花不少钱, 也许
seller就会决定不卖给我们了, 另找买家.

A prior owner (“Ed”) owned this property. Ed died and in his will be left
his property in trust to a Mr. Bob. Mr. Bob was to hold the property in a
trust until Mr. Ed’s daughter Mary turned 21. Once Mary turned 21 Mr. Bob
was to pay over the property to Mary. This was never done. I have run this
scenario by my title companies and they both have differing opinions.
Title Company #1: They are fine with this issue. They state Mary
was already 21 at the time her dad died (the will was made while she was a
minor) so the property went directly to her.
Title Company #2: They have an issue. They think that the words
“pay over” require that the trustee sign a deed to Mary.

这样的问题就是买房为啥找律师,卖方不clear这个问题,坚决不能要,

所以现在是mr bob在卖房子?但是prior owner的遗嘱是要把房子给她女儿的?

经过几天的回合, title company #2似乎也不太不确定有没有问题. 我们律师说她自己
也不觉得有问题, 所以, 现在她的话是: “My office will issue you an attorney
certification stating you will get good marketable title. You will also
receive a clean title policy.”
我的问题是, 这个 “attorney certification stating you will get good
marketable title” 就等于一个clean title 吗? 以后卖房子时, 买方是看我们有的

如果实在想要房子,title insurance肯定要买上,lender肯定会要求买,你自己也要

麻烦个鸟啊。就算是有问题也只会是Bob才有理由来争。他人都死了,还怎么争?而且
遗嘱的目的是房产最终交到Mary手中。现在房产的确在mary手中,是她本人在卖,怎么
看都不是有问题的样子。
最后,既然title company 1 认为没问题,他们愿意出title保险,即便有问题,你也
不会有什么损失啊。
