Re: Gen. Laws Chapter 93A Demand for Relief for Unfair and Deceptive
Business Practices
Dear Sir/Madam:I am writing to you under the provisions of Massachusetts
General Laws Chapter 93A, Section 9, to demand compensation for the losses
we have suffered as a result of American Express’s unfair and deceptive
business practices. In 201?, American Express entered into a written
contract with Mr. (your last name) {state facts here} ............... We
have waited for 2 months and 19 days, nothing happened. So we call them,
they said due to the violation we won't get our money back. We are waiting
for supervisor to call us back. However, judging by the way their reps
replied, we will not get the money back even I tell them I will sue them if
things has to boil down like this.By this letter, the xxxxxs hereby demand:
American Express May 21, 2015 Page 21. That American Express pay us the sum
of $2498.15, which sum consists of the following:a. A refund to us of the $2
,498.15 they paid to American Express under the contract for work American
Express failed to perform; and b. Twelve percent (12%) statutory interest on
the monies we paid to American Express, accrued from the date of American
Express’s breach of the agreement Please contact me immediately to arrange
for payment of the $2,498.15 to which the xxxxxxx (your last name) are
clearly entitled. If we do not receive that payment within 30 days of the
date of this letter, they will file suit against American Express for breach
of contract and violation of Chapter 93A. Please understand that if your
conduct is found to be unfair and deceptive under Chapter 93A, we will be
awarded their actual damages and will automatically receive an award whereby
you will be required to pay our reasonable attorneys’ fees. In addition,
if the Court determines that American Express’s conduct was willfully or
knowingly unfair or deceptive, or if American Express fails to respond to
this demand in good faith, the Court must award us up to three times, but
not less than two times, our actual damages, an amount that could easily
exceed $7,500. I look forward to American Express’s prompt payment to us
