(2) they are smart people, and they have armies of consultants working for them so they understand how H1B/EB system works. From their perspective, 3012 will bring some fairness(to the EB applicants) to an unfair (to the US workers) system. That's where the problem is because 3012 wouldn't alleviate a bit burden from the US job seekers. And that's exactly the reason why Grassley has put a hold on the bill. A possible provision will be something like to jack up the application fee for PERM/140/485 by thousand dollars per head for training US job seekers.
