本人F1-OPT，使用1040NR-EZ和8843报税，只有W2,没有1042S，W2里也没有扣除$
5000treaty，
请问在报1040NR-EZ时，要求了5000刀的treaty，是否还需要填写8833表？还是说，F1
学生可以不
用交8833？

If your W2-box1 amount does not exclude $5000 treaty amount, you need 8833.
In your case, u need 8833.

查你的SEVIS #,应该是相同的，不用交

我的理解是8833是为了让变成resident的人用treaty overrun "saving clause"(美国与
各国关税协定中允许美国对resident按美国法律收税)用的,所以对我们填1040NR没什么
用.
根据notice 1392,你如果W2没有扣掉5000,你在报税的时候提供proof证明自己适用trea
ty,我理解是需要护照I20签证和一个statement说明(你如果填过8233就需要提供这些,我
附一个在下面)
