I don't know where to send it out , so I put it here.
ld graduated from top university (Beijing Medical University) in china, but is a SHUDAIZI, worked at top university ( Harvard medical school) in the US. Because my landlord made so much trouble for my family, he lost job now. applying for residence now. We have to go to court on November 21, 2011. I have four kids and all kids are high fever now. I have no idea how to argue in the court.
自从去年move to MA，厄运不断，房东(apartment)告我们去法庭，并在我们生孩子的
那段时间，私自与我们的律师去法庭。让我们输了官司,(first case) 并驱逐我们出
去. 还不退还我们最后一个月的压金. Second case让我们赔七千块钱(floor damage
fee 3000, wall damage fee 2000, sink damage fee 500…)下周是关于七千块钱上
庭，自从我们输了这场官司以后，律师不在代表我们出庭. I think my landlord only
can charge my money from wall, 关与孩子(all kids under 5 years)在墙上画画
line，我已混刷，但有些艳色不一样，即然房东那么恶毒，我干脆死不认账。自从我搬
来wall就是那个艳色, I don’t know this answer be good, 如果成立他就没理由扣
我两千块钱墙壁损失费. No more reason charge my 7000 $

we have to move out and find another apartment after we lost first case, we have
no way to find suitable apartment during a week, so we move in another two bed room apartment. However, the second landlord also asked my family to move out during one week.because of we have a lot kids, She also charged my family $ 1100 after we moved out.
reasen; another landlord called ld that"we so sorry for my office someone make a matter, we don't charge you any fee if you in one week move out.''
It should be noted that not only the first landlord didn't return my last month payment but he also went to the court again and wanted charged my family $7000.
We will go to the court on November 21, 2011.
Does anyone have some idea how to handle this case.

去法律版问过吗？如果只是在墙上画画，这个要的钱太过分了。
请人粉刷整个apartment的墙根本不要2000。地板和sink是怎么
回事？难道要换所有地板？你可以要求房东出示所有修理费用的
发票。你的律师为什么不管了呢？

你找律师都处理不了的问题，指望这里帮你处理？先换个好律师吧。再说为什么第二家
房东又向你们要钱？你光说对方的不对，不说自己做了些什么，指望听到有用的意见？

repair worker.
Acturly my law saled me, court first notied time on march 17, but ld
vacation and arranged all sth, prepared to go to court that day, my law
calling ld that landlord cance that time case, and contine let my law argue
with us,so no resoult to argue , and we find anther legal service , actually
we have don’t believe my law ,no get any information since that, and get
court letter that we lost case induring we delevered baby, so we have to
move out.

理解你焦急的心情，不过建议你写中文，这英文写得也太那个了....

建议你在那里用中文问，至少能表达清楚。另外问的时候把
前因后果仔细写清楚。比如地板，墙上跟住进去的时候比到
底有什么损坏，水槽那里是否garbage disposal坏了，是否
你们使用不当引起的

for the wall, it depents on the square footage. For 2000 sq, it costs about
$1800 (labor) to repaint (ceiling is not included). The paint itself cost $
500-600.
for the sink. to replace the disposal, it costs about $100. Labor fee is
about $60/hr. the the total should be about $160.
Floor - it denpends whether it is carpet or hardwood floor. Normally it is
really hard to match the existing ones. To repair, it normally need to
replace the whole room. Depend on the material, normally apartment carpet
cost about $600 for a small size room.
In order to win the case, you need hard proof. some pictures show the
codition when you first move in. If you lost the case and didn't pay, the
landlord can do the following thing:
- put an eviction record on your credit report
- garnish your wage
- send your information to collection. It will also show on your credit
report.
Next time, when you move in, you should ask the landlord for a check list
and take some pictures. It should list out the conditions of each items in
the house at the beginning. This will avoid a lot of trouble later on. And
it is a two way swords, it may help or hurt you depends largely on your kids
.
Just be objective, since you have so many young kids, there must be some
damages done to the place. The best way to avoid all the trouble is to
purchase a house.

这个很诡异啊。
另外，第二个房东为啥也让楼主搬走，就是因为孩子太多么，还是有别的事情楼主难以
说明？

你家到底有多少孩子，3－5个在美国都很常见得，你们当地房价如何，如果不贵为什么
自己不买房？

LZ 虽然我很同情你，不过你这半中半英的，英文半生不熟的看的不爽啊。特别是第１
段话，已经把我绕晕了，谁失业了啊？
大部分APT里面住多少个人都有要求的。如果你开始隐瞒了，很快被人发现了，他们有
权利喊你搬走的。如果你们家４个孩子，其实可以考虑租个房子。
下面我要打酱油了。４个小孩子全部都小于５岁。是不是可以请他们别在墙上乱写乱画
啊，在纸上画不是更好吗？要不你随便住那里，以后还是要继续被罚款。

又看了一遍，ma房价贵，你们现在买房的确很困难，4个孩子，中国人里面很少见啊！
都很小吗？能教育孩子不在墙上乱涂吗？庭上不能撒谎，对你非常不利，房东请几个房客来作证就可能证明你撒谎，撒谎在美国很严重啊！

同意，不要想撒谎说墙原来就是那花颜色，这个很容易被揭穿，以后对你更不利。
建议LZ把逻辑理清楚了，用中文去LAW版求助。

thank everyone response, 委屈 everyone,for my pool English, my computer can
’t tip Chinese , one SHUDAIZI, one TOUBIE , downlord Chinese soft not work
at all. Those Chinese what i get it by skype
actually , we were brushing wall, my landlord came in, and almost fight with
us, so police call in, too. We contuine to take some picture for go to
court, again.
We don’t damage sink, police sald ‘ of course your landlord repair it.’
Second apartment, 2 bedroom, our kids like this preschool and day care in
this town, in rent office that young guy didn’t ask;’how many people do
you have?’
but for serve question that I have to find some idea from other people. you
can call 7323228255 if you have good idea with handle.
Another question ; I don’t know what’s wrong; top medicine university(6
years) in china, research 10 years, almost 40 papers, apply resident almost
200, no a interview until now. Depressing

Even if the 2nd apartment didn't ask how many of you will be living there, I
'm sure that number is on the contract. Did you read the contract before
signing it?

确定不是挖坑？这求助看得我十分窝囊。
lz，我的建议是如果你无法表达清楚事情的来龙去脉，就不要找老美律师，找会说中文
的律师吧。我觉得不说中文的律师是没耐心接你这个官司的，一些没品的律师还会欺负
你们。
另外，按理说按lz自述的社会地位实在不该受到如此粗暴和不公正的待遇，lz确定客观
的陈述了所有的事实？

sorry Omelette, i no time 挖坑, go to court next week.actully we have gone
to court on Oct. 24, but that landlord law go wrong No.room.so judge said
dismiss that case,but second day received court letter again. we need go to
court on Nov 21, again. we almost get ''CHI DAI''.
老美律师is free.
We rent apartment before ,we know it only be a procedure. So never not
care of read it when make contract . we find law and sign contract at all.
So that that law change ld to go to court and lost first case as well.
Actually I no sign that name what law contract.
third case we no matter. But no paper proof. Only telephone proof.

安慰下，英文不好的话很多事很吃亏的，在别人国家讨生活不容易啊。
至于中文输入，现在的windows,mac都自带中文输入，在设置里面改一
下就可以了，不用另外装软件的。你用的什么操作系统？

Up date , Just come back from court, i don’t know why this case dismiss
again today? and that landlord lady take more bill to me, about 6800$ repair
fee. Next court time on Jan 30, 2012.
I want to find a free lawer, the lawer fee pay by government. have more
socive worker. another question find a interpreter , this fee pay by court.

如果是低收入的話可以找當地的legal aid,他們會提供免費法律服務,有時候甚至提供
翻譯,比如這個 http://www.gbls.org/get-legal-help/ch, 不過不知道你是不是波士頓的.
如果不符合低收入,就不知道能不能找到免費律師了.至少找個英語好的朋友吧,把你的
合同好好看看.另外不要撒謊,弊大於利.
