That's not exact reason caused backlog, There are multiple reasons for
backlog.Up until 2004 April, GC are 100k and equal to incoming H1's almost.
1.That time Bush govt has cut number of employment H1's to 65k. This should
have resulted surplus GC's.
2.USCIS started new PERM system, While the system is being developed, They
made all LC's backlogged all LC's that are pending for an approval.
3.They started new BEC(Backlog elimination centers) around 2004 in Three
places . PERM started end of 2005-2006, New LC's were processed in PERM.
During this time, they wasted over 150-200K GC's supposed to be used for all
these backlogged LC's. Hypothetically as no LC's, no 485's filled to use GC
's. So they just wasted.
4.BEC's asked employers to re-confirm on continuing LC' processing called
CRNL to reply with in 45 days of that letter. They took 2.5 to 3 yrs to
clear all those LC's filed under RIR and regular methods.
Since no end date on LC use, almost every employer replied that they wanted
to continue processing LC's they filed, Some withdrawn. Most people know
employes sold LC's like a black market taking advantage of LC backlog.
5.Then labor dept put end date on past approved LC's that are unused by
employers, By the time rules published the employers took advantage of re-
using all their unused LC's they have by substitutes. That's how we still
see 1999,2000 old PD's mostly as substitutes.
6. With no FIFO,They made all current in July 2007 suddenly, bumped up high
numbers in system for all categories. People requested to recapture wasted
GC's. There was senate committee that inquired on visas wasted, possible re-
capture but nothing recaptured.
7.Retrogressed all EB. This caused issues on H1's extn troubles that are
nearer or reached 6yrs limit so they came up with AC21 Act and memo's and
then ROW, Non-ROW stuff.
8.Around 2008 allowed 245 i/k amnesty stuff. More added to EB3 as no sub-
classifications in it.
9.They kept holding all doing back n forth unreal movement drama from 1998
to 2002 June in EB3 for all for about 6 years.
10.Then they moved China and Mexico EB3 up but not for India
11. Some lobbied on spillover rules change, came up with STEM etc.
