Sorry, I cannot type Chinese.
I didn't get my H-1b visa this year, my OPT extension expires August 31,
2015. I joined my current company since December 2014 (< l year). Because of
my OPT expiration in August, the company has to terminate my employment
even before my 1 full year service. Do I need to pay back the large amount
of relocation cost as this is not my voluntary termination of employment? It
was caused by some other visa problem. (The offer letter said "If, within
12 months of your official start date with the Company, your employment with
XXX Company terminates for any of the reasons described in the Relocation
Repayment Agreement, including your voluntary termination of employment with
xxx Company or your termination for cause, you will be
required to repay 100% of the relocation expenses incurred on your behalf.")
I just want to know if anyone had this experience before.Thank you

ask hr; they may be sympathetic and waive the request

it says: I need to pay back if
Voluntarily terminate employment for any reason whatsoever, including
retirement, or
Are dismissed by the Company for cause as defined by the Company’s
Severance Plan, or
Fail to physically relocate to your Destination Residence and Destination
Location within one year from your Effective Date of Transfer in accordance
with IRS guidelines.

Negotiate with the company. I guess most companies are nice enough to waive
it.
However it seems that if the company insists that you should payback, you
will have to.
