看上一short sale 房, 屋主06年40多万买的(几乎0 downpay),现在short sale, 我
们出了20来万,该签binder contract了。
问题来了:对方律师要求$2000 downpay in escrow (不能用copy of check), 而且要
求做title search, 而且我的律师告诉我银行如果批了肯定是sold as is, 因此建议我
们在签之前就做inspection.这样在得到银行的任何答复之前,律师费(1st pay)+
title search + inspection就1~2千块了,而且还有downpay.
以前在版上看到downpay 有人建议用copy of check, 而且没有看到有讨论title
search+inspection的 (before bank approval/counter offer). 因此想问问版上大
虾们这是纽约州的规定还是律师这里有猫腻? 谢谢各位建议!

sounds like you are working with pros who really know about short sale. OK,
for the inspection: if you do it before your received approval from the lien
holders, you can actually know 1) whether to wait for the approval or move
on since short sale will be an "as is" sale. There's no credit for repairing
or any repairs from the lien holder. 2) you may be able to negotiate some
credit from the seller and once you and the seller agree on the credit,
seller's lawyer may be able to get it for you. that's your benefit part. of
cause if the lien holder does approve the sale, you will not get the money
for the inspection back. so it will be your call. spend a little for bigger
gain or spend nothing for nothing.
for the EM, the seller's lawyer doesn't want you to walk since he/she will
the one who does the work. if they hold nothing against you, you can walk
free at any time before the approval letter arrived. they don't want that
happen so they ask you to put a little money there.

Thanks a lot for your reply!
Still question on the title search part before bank's approval. My attorney
told me it usually takes 4 weeks and she can push it to get it in 3 weeks.
But I don't understand why the seller's attorney cares about it and requires
it in the contract. Looks like another binding to prevent me to walk away
due to the money spent on it. Is that so?

lien and/or any other liens. there may have more liens than even they know
about. seller's lawyer is not the seller. she has to make sure that she can
get paid by getting the job done which is a good thing for all of you, both
you as the buyer and the seller. title search shouldn't cost you anything if
the transaction failed to close which is true for our state.
