and you should hold yourself for higher standard than non-resident, tax
evasion can be the reason to revoke your GC.

谢谢楼上两位的回复.但是估计两位的解答是看到皮匠博客所说的。
我们没有拿绿卡前就是以RESIDENT的身份报税的.因为是以H1B身份来美的.
关于这个中美条约我又考一下古,找到一些相应的解答:应该是可以享受的.
我在网上找到的一些答案:有理有据吧.

saving clause。请详读pub 514第54页，特别以中美条约为例。

example, under the U.S.-People’s Republic of China treaty); others
applyonly to resident aliens who are not lawful permanent residents of
theUnitedStates (green card holders)."
特别指出对中国的条例适用于所有resident aliens （应该包括green card holders）
，而别的国家条例可能只针对非绿卡持有人的。
因为GREEN CARD HOLDER 也是RESIDENT ALIENS.(还不是公民噢)

IRS, 2009 is counted as one full year for you.

这个我不是太清楚.但是从TAX版看到的:
来自中国的H1访问学者可以免3年income tax，累计36个月。
他们用的是累计36个月.并且现在交也是退2011年的税啊.

Yes you can according to the savings clause of the treaty. If you go to the
text you'll find the treaty remains effective even if you have GC.
Disclaimer: my interpretation is just fyi. I'm not an attorney.
