DC RALLY ON NOV 16 2015 IN FRONT OF WHITE HOUSE:
Requesting all Skilled Immigrants affected by #visagate2015 and stuck in
severe Green Card backlogs to participate in a rally in DC on November 16
2015. Almost a year has passed since Executive Actions were proposed by
White House with no positive outcome whatsoever for legal immigrants stuck
in backlogs. One of important proposals in the Executive action was Visa
Modernization, which was supposed to remove all uncertainties around Visa
Bulletin, and make it a transparent and predictable system to help Legal
Immigrants. On September 9, 2015, new changes were introduced in the October
2015 visa bulletin resulting in forward movements for several categories,
giving hope to thousands of us and our families in Green Card limbo.
Those hopes were crushed by USCIS 16 days later, when it revised the October
visa bulletin on September 25 2015, moving the Green Card application
filing dates back by several years, making most of those families ineligible
for applying in October. In the meantime, all these families have spent
several thousand dollars on Medical Reports and Attorney fees in preparation
for the Green Card application filing. Some of us have rejected exciting
job offers in the hope of filing Green Card application based on our current
employment, resulting in loss of money, and career advancements.
To compound the distress and confusion, the State Department & USCIS appear
to be at loggerheads with each other. This is evident from the Nov 2015 visa
bulletin, which asks us to look at two different tables and wait for an
additional week to see if we are eligible to file our Green Card
applications. VISA MODERNIZATION WAS SUPPOSED TO EASE THE PROCESS, NOT ADD
MORE CONFUSION, AND UNDUE BURDEN LAW ABIDING TAX PAYING IMMIGRANTS.
Another important proposal in the Executive Action was a regulation for job
portability, and EAD/AP (1615-AC05) for high skilled immigrants having
approved I-140 petitions. This was supposedly being worked on by USCIS, as
communicated by its Director in a stakeholders teleconference earlier this
year. However, this regulation is yet to be submitted to OMB, among the
first steps in a long rule-making process, although the draft rule was
scheduled for publication in October 2015.
As law abiding tax paying skilled Immigrants stuck in decade long backlogs
in an obsolete immigration system that does not make any sense in a global
economy where talent should be rewarded, not punished, we need to stand up
for our rights, and let the world know that we can longer be taken for
granted.
IF NOT NOW, WHEN? THE TIME HAS COME TO GET TOGETHER, AND RAISE OUR VOICES,
AND EXPRESS OUR FRUSTRATION WITH THE OUTDATED AND ABSURD IMMIGRATION SYTEM,
AND DEMAND REAL CHANGE AND IMPROVEMENT, NOT MERE LIP SERVICE AND PAPER
REFORM.
