记得前几天看了一个帖子说amex理论上可以最多开999张副卡？记不清具体数字也找不
到帖子了。

15/11 被audit
今天收到被拒律师说的原因是qualification 解释不明的原因（具体什么情况明天
需要去他们那里了解）。建议是request reconsideration。
请问有没有人有类似的经验的能够帮忙介绍一下我该怎么和律师谈。现在如果换律师
的话有用吗
一般这种情况的还有希望通过吗？
这是律师的回信说明的原因。
Based on the design of Form 9089 is not clear, and DOL's recent change of
policy, a lot of PERM/9089 cases were denied for the same reason.
Within 30 days, we shall file a "motion to reconsider", amend the Form,
attach a letter from your company to explain those requirements are inquired
because of 'business necessity' and a letter/Affidavit from XXX to prove
that she owns those skill/knowledge, etc.

PD差不多，不过我是12月被denied. 居然现在audit结果都比reconsideration快。现在
还在苦等reconsideration中。

你被拒的原因是什么？
律师有没有告诉你如果motion to request 再被拒的话是不是必须走balca了还是可以
withdrawal cast。这事情烦死啊。

我在担心的是这个，不知道是不是考虑 withdrawal。。
Motion for Reconsideration Could Become an Appeal
If the employer files a motion for reconsideration of the denied PERM
application, the CO has a choice. The CO can grant the motion for
reconsideration and reopen the denied PERM application. Alternatively, the
CO could deny the motion for reconsideration, and treat the motion as a
request for a BALCA appeal / review. If the employer elects to proceed, the
case is forwarded to BALCA for appellate review.

bless，我之前perm audit悲剧不过原因不一样，recon之后过了，现在140pp也过了，
所以还是有点希望的。当时recon大概四个月包括圣诞假期，所以就一边等一边找工作
准备跳槽

同情一下。如果舍不得自己的pd,可以file reconsideration, 同时准备新perm。不要
考虑BALCA了吧，等的时间太长了。

没有考虑balca。
现在就考虑看看有没有必要file reconsideration。
拿到denial letter，具体的原因是。
the foreign worker's specifications as listed on ETA 9089 do not demonstrate
that the foreign worker meets the requirements as described in Section H of
the application.
我咨询过别的律师，结论是我现在的律师把 section H的内容填错了。导致的拒绝
。现在不知道要不要file reconsideration。还是start a new perm。妈的，浪费
了一年多。

我上次申请也是这样被拒了。。。一模一样的被拒原因。我的问题是我的
specification里边少写了我一个certificate，但是requirement里边就写了。。file
reconsideration 再次被拒。。不知道你具体是什么东西不match。。我
reconsideration再次被拒的原因是：他说这个申请是一个非常严格的过程，第一次申
请表就应该写好，没写好的就不让改了之类的，现在在file第二次perm。。。仅作参考

看了楼上面的回答，觉得还是重新file吧。我是没得选，被denied的时候hr都不告诉
我直接就让律师给request for reconsideration了。为此我还找过老板抱怨。但我的
情况又稍微不同，我是因为打广告的报纸选得不好，选了一个邻州的报纸，但其实确实
在公司这里流通的。但DOL觉得邻州报纸好像不应该在公司所在地流通似的。这个确实
没办法，我亲自查看了所有记录并确认了在本地就是有那个报纸，所以大家一致认为是
DOL的错。所以reconsideration就罢了。
但我下周会发信给hr，说明如果再次被拒，我要请求重新file perm，因为现在BALCA审
一个案子要三年以上。开什么国际玩笑。trackitt里居然有老印同意公司给上诉到
BALCA，我也是醉了。

如果真是律师填错表了，还是重新办个PERM成功的可能性高些，别在Reconsideration
上继续浪费时间了。

请问specification是指哪里？ Section H, 第11项Job duty吗？Requirement是指哪里
？ Section H, 第14项Specific skills or other requirements吗？看了下我的9089
表，证书也没写在11项里，而是放在14项。有问题吗？

我audit 好像签了个文件说我自己没有付律师费。没有给雇主任何补偿律师费
deny 说我表里面有个广告日期没有填，律师说在audit的时候附件广告原文都交了。
然后律师说file 的是什么 error 我忘了，不是 reconsideration 。然后过了四个月
才批了

我的理解是不被audit 都没有什么问题。被audit 估计会有问题。 audit的会被查的
非常严格。

你这个是reconsideration。你这个还好。不是什么大事。我那个估计比较悬。

你知道有类似的被拒的reconsider还能过的？
最近查到的结果都是negative的。还没有遇到positive的情况。。
