To Whom It May Concern,
We are a group of people who have applied our permanent residencies under
EB1 (researcher with extraordinary ability and outstanding researcher and
professors) category with approved immigrant petition for alien worker (I-
140). We are now waiting for ad justification of status to a permanent
resident of the United States (I-485). However, we have recently noticed
that a significant delay in processing I-485 applications under EB1 category
at either TSC or NSC, although most of our cases have exceeded the 4-month
time frame specified by USCIS. At the same time, many I-485 applications
under EB2 category have been recently approved by USCIS after a significant
advance of EB2I (Indian) and EB2C (China) cutoff date.
We are very concerned that UCSIS has weighed their workforce on processing
EB2 cases and neglected EB1. The purpose of establishment of EB1 (first
preference) is to keep talented scientists in USA by granting them permanent
residencies through a fast track. We believe the dramatic delay in EB1 I-485
approval have hurt the interests on both the applicants and their employers:
1. It will delay talented foreign scientists to start their own business
, which will fuel the nation’s economy, stimulate investment, and spur job
creation.
2. It will exclude many talented foreign scientists from getting more
funds and projects for their employer; thus blocked their employer from
making more profit and creating more jobs.
3. It will prevent talented foreign scientists from international traveling
for business and conferences
We therefore request that USCIS consider speeding up the process of EB1 I-
485 applications and providing a more clear track for EB1 I-485 processing
or
a fast lane through premium processing, which is actually very feasible due
to limited number of applicants.
