The issue is new candidate qualifies based on check list not the reason to
reject. It's easy to reject application but not easy to convince the auditor
.
You may consider a new position in your company but it needs to be at least
40% different from your current job (again, based on JD), so your current
experience can be used.
Or, review the jd check list and translate your current project and
expertise into requirements (but ensure your prior experience has the
similar requirements), more specific will be better. Honestly, your current
PERM has been denied, it will be really difficult to use the same company/
position but a new JD to convince labor department... I'd ask the lawyer to
present a similar successful case before moving on... Good luck
