关键就在这位大法官Anthony Kennedy的这一段话：
“The reason this is concerning is because it requires the individual to do
an affirmative act. In the law of torts, our tradition, our law, has been
that you don’t have the duty to rescue someone if that person is in danger.
The blind man is walking in front of a car and you do not have a duty to
stop him absent some relation between you. And there is some severe moral
criticisms of that rule but that’s generally the rule. And here, the
government is saying that the federal government has a duty to tell the
individual citizen that it must act, and that is different from what we have
in previous cases, and that changes the relationship of the federal
government to the individual in a very fundamental way.”

到底是搞不搞？
我希望强制保险，因为急诊室被强制收病人，钱是算税金的，还得我交。
如果我不用被强制救人的话，要么急诊室不用被强制收病人，要么所有人都把这个钱交
了。
当然这样有点理想化，最后一定是不了了之。

The key differences are:
Hospital is an organization, a firm, therefore subject to regulations
applicable to the enterprise.
However, individual (even an off-duty doctor) does NOT have the obligation
to save other people.

But it is individual who earn tax, even cooperation money comes from
laboring individuals. Without individual I do not know any money-earning is
fundamentally possible.
Even organization saves people but they are really using tax money that
comes from individual.

designed to force individuals to participate.

it will be paid by you and other tax payers any way
with obamacare, you will not only pay for other peoples' emergency room
expense, but any health care expenses because they will all be frunded by
tax.

2) You have the freedom of not to drive. No one can force you to acquire a
driver license, therefore, to carry a auto insurance.
