You cannot get 3 years of H-1B extension if the 140 is revoked, but you can
get 1 year of extension regardless of 140 status based on AC21 106(a).

Your firm cannot revoke your I140 unless there is a fraud. Therefore, the
chance they will revoke your I140 is extremely small. You can extend your
H1B in an incremental of 3 years with an approved I140. I was in the same

如果有披了的140，新H1B直接延期3年。我就是这个情况。

我的理解是只要P140 revoke不是因为fraud，新perm时可以pickup原来的PD。求证实

办新H1B时，旧公司应该还不知道你要换工作。新H1B自动延长3年。这个要用旧
140aproval Copy。
等新H1B批准再和旧工司说。

可以办h1b transfer时，就拿140延三年吧。 三年时间也够在新公司拿到140了

按照我咨询的律师，如果前雇主不厚道，把你的140 withdraw的话，严格说来你的PD是
不能保留的，但是很多情况也蒙混过关了。我也和你一样的情况，想跳槽而纠结。
