Service records indicate that your Request for Evidence response was
reviewed by the issuing officer. That officer has placed these applications
on hold at this time, as he was unable to process the cases to completion.
Records indicate that these I-485 applications are employment-based, based
upon an approved I-140 petition. That I-140 was approved for a second
preference immigrant worker from China, with the priority date of February
20, 2009.
Although the current visa bulletin indicates the applicant is eligible to
adjust based on the published priority dates, demand for EB2 numbers has
increased dramatically during recent months, and at a much faster rate than
had been expected based on the rapid forward movement of the cut-off date.
Therefore, it has been necessary to retrogress the China/India EB2 category
in an attempt to hold number use within the annual limit, and maintain
availability for those countries which have not yet reached their per-
country limit.
Unless there is a drastic change in the current rate of number use, EB2
numbers will not be available until October 1st, under the FY-2013 annual
limit. Department of State is indicating that it will not be possible to
speculate on the cut-off date which may apply at that time until sometime in
late summer.
