advice is free here. take it at your own risk.
Since you have EAD, you don't need H1.
Even without EAD, people would ignore the 2-3 week "gap", if you call it
that way, which is not a gap at all.
If you apply for H4, you have to wait till your new H1B is approved to start
working.

I thought EAD only keeps applicant in legal status if he or she is using it
for working.
