my lawyer interfiled EB3 i-140 and i-485 for me recently. when i asked her
about the benefit of requesting PP, here was what she said.
"the PP only applies to i-140, but not to i-485. even if i-140 is approved
sooner by using PP, you still normally have to wait several months for i-485
to get approved in order to obtain the GC. the only requirement is that i-
140 should be approved before i-485 would be completed. so there is no
guarantee that using PP for i-140 would make the overall processing of GC
application faster."
so my questions are:
1. is the purpose of i-140 just to obtain a priority date?
2. if EB3 i-140 is approved, does the priority date remain the same as the
earlier one from the last EB2 i-140?
3. what is the regular processing time for i-140 and i-485 respectively? is
i-140 normally processed faster than i-485?
4. what would be the advantage/disadvantage of requesting PP for EB3 i-140?
5. how would EB3 i-140 and i-485 be affected in case priority date
retrogressed?
