Hi All,
I was working as a software systems
engineer position in company A, applied I140 with second preference. It got
approved when i moved to another company B, worked as a programmer analyst
and
applied 485 in third preference. Now I am working with company C(with decent
salary higher than company A and B) with EAD,
applied AC21 too I came to know that this RFE is from AC21 and not the one I
poster earlier.
Recently we got RFE regarding AC21 porting.
It is noted that
the salary quoted by Company C appears to be more in line with Software
systems
engineer position from your second preference I140 from company A, although
the
job description appears to be more in line with programmer analyst position
from the third preference I140 from company B.
Please submit a new employment letter from Company C
clarifying your job description, as it must be same or similiar to Software
Systems engineer, if you want to use EB2.
Please respond with the format or suggestions to post new employment letter.
I will appreciate if anyone can help me in this regard.

If you intend to return to work permanently for Company A and they have not
withdrawn the approved I-140 filed on your behalf, you can make a request to
USCIS to interfile, or replace Company B's EB3 I-140 with Company A's EB2 I
-140 since you already have a pending I-485. You can also request retention
of your earlier priority date from Company B's petition.
Another option would be to find another employer to file a new EB2 case for
you and request retention of the September 2003 priority date from Company B
's EB3 petition.
You may also interfile Company A's EB2 I-140 as described above and
subsequently use AC21 to move to a new job in a same or similar occupational
classification as the job offer from Company A.
