I am currently employed in academia. Originally, my H1-b was approved and
renewed until April 2016. I just heard from the boss and HR, and they might
break the contract due to the shortage of existing funding, which means
there is a chance I cannot continue my position after Dec 31-2015.
What should I do to make myself legally in US quickly?
My EB-2 (NIW) I-140 was approved (PD. Feb 2-2012) previously, and it looks
like there is a chance I could submit my I-485 in the next a few months.
I also consulted with my immigration attorney, and he/she encouraged me to
apply for EB1a. I have some criteria to meet the EB1a requirements.
I think this forum is always very helpful, and my question is that:
Should I just wait for EB2 VB becoming available or should I prepare and
submit EB1a application as a backup plan? Would it make a timely difference?

why don't try EB1 regardless even if you have time to wait for EB2?

你这个PD，不久就可以交485，但什么时候拿绿卡，不好说。
你要有精力折腾，当然就折腾一下子了，不过那也至少得花上个几个月。更重要的是找
下家吧，academia找工作又不需要绿卡。

eb1 now！就算你交了485，今年也不一定能马上拿到绿卡。可以等一类准备好了，140
批了再把二类的485 relink过去，不用重新交485

Thank you for your reply. Are you suggesting me to only submit Eb1a I-140,
rather than Eb1a I-140/I485 concurrent application simultaneously?
It sounds a good strategy!

May I ask you a quick questions? I am very short of knowledge on immigration
processing.
What is the current status of AP/EAD application if I can submit I-485 for
EB2 (NIW)?
For example, in case I am eligible to submit I-485 form next month (May 1st)
, I could apply for AP/EAD at the same time, right? How long will it take to
have AP/EAD approved based on information collected on this forum?

Thank you, I will work on this direction as well. Although, I am not
interested in academia anymore. However, it seems that I have to compromise
the situation for temporally legal status.

这种事情真得靠自己决定，你今年内用niw肯定可以交485 AOS合法呆在美国免费使用
EAD/AP工作出入境无非就是等呗当然了大多数大陆人的心态就一不放心整天p颠p颠
得担心如果这个被据那个被炒怎么办的都睡不着觉，因此正和移民律师下怀各种
apllications一起上挣钱呗不光是eb1a 一堆一堆的有ead的还应要花钱办h延期的呢
最后一个个接着evl RFE还美滋滋的要命无所谓啦麻烦hr和公司的钱养肥律师又算啥
花钱费事不要紧要紧的是就爱买个俺大陆人的放心嗯

Actually, I am one of that type of people who do not really care to get the
actual green card, as long as I can stay here and work and live. That's the
reason that I did not initiate my applications at a quite late career stage
comparing to my friends and colleagues with a similar background. I think
everything you said is understandable and quite logical. Thank you for
spending your time and answering my stupid questions.

现在的问题是工作问题，不是绿卡的问题，有工作了绿卡就保住了。
