骑驴找马,最近拿到别的公司offer,可绿卡也有可能马上拿到了。听说如果拿到绿卡
就换工作,以后入籍的时候可能会有问题。想问一下,这个问题大吗?有没有前辈这么
干过的来分享一下经验啊?
本来还说拿到绿卡就方便换工作了,结果反而更麻烦,还不如绿卡没批用AC21 port
485申请,唉。。。

刚刚跟律师确认过了,因为新公司的工作和PERM申请的工作是一个种类,所以拿到绿卡
就换工作是没问题的。下面是律师的原话:
"As background, the general guidance is that you must remain with the
petitioning employer for a reasonable period after receiving your green card
as the green card was based on the PERM job opportunity. However, this is
not applicable in the AOS portability context."
"The general guidance is for AOS applicants that are not eligible for
portability so it is not applicable to you."

就换工作是没问题的。下面是律师的原话:
"As background, the general guidance is that you must remain with the

没看明白噢。 如果没有ead ap 直接就拿到绿卡了,难道不能马上走?

没听说过还有这个问题。生物薄厚一辈子搞生物?
有时间限制没?比如拿卡多久后可换其他行业?

In today's dynamic market, many people want to know how long does an
employee who receives employment based green card needs to work for the same
employer after getting the green card. There is no precise answer to this
question. The law states that if the employee left within 2 years, the
employee has burden to prove that he/she accepted the job offer in good
faith and didn't intend to leave at the time of accepting permanent
residence. If it is more than 2 years, the burden comes to USCIS to prove
that. The theory behind green card through offer of employment is that an
employee is accepting a job on a "permanent" basis. But "permanent"
obviously does not mean forever as it does not make sense. But it also does
not mean that the person leaves the company the day he/she gets the green
card. Each case would be different depending upon employee-employer
relationship. But in general, staying with the same company for about 6
months to 1 year should be enough indication of permanency. "Permanent"
means that, at the time the employee becomes a lawful permanent resident,
neither the employer nor the employee have any plans to change the
employment relationship described in the labor certification or I-140
petition. If you leave too soon, USCIS may claim that you did not intend to
take the job up on a "permanent" basis. If the employer(or even a jealous co
-worker) is dissatisfied with you leaving too soon, they can file a
complaint with USCIS and USCIS may either take any action or not depending
upon the circumstances. USCIS also may find out about you leaving too soon
while later applying for citizenship or petitioning for relatives.
