Here it is my timeline.
PD 10/2011
RD 01/2014
In May 2014, got letter, that said pending with back ground check and cutoff
date retrogress.
In March 2015, got letter from USCIS when priority date id current, it said
stuck with FBI name check. And I contact FBI, it said, USCIS asked FBI name
check on Jan 2014, and FBI response on March 2014. So I used FBI letter to
contact USCIS on May. USCIS issued RFE(medical exam) on May and Cut-Off date
retrogress again.
In October, continue to contact USCIS, on October 30 and got response, it
notify Supervisor and will get notification of decision within thirty days.
On October 18, the second RFE for medical exam(It said we use old form on
June), to avoid unnecessary hassle, to re-mail the forms again on Dec 8,
2015.
Since it is always under extend review(it involve national security...). On
February 8th(The Spring Festival), I drove 5 hours for InforPass and waited
1 hour, it took 5 minutes, the middle-aged lady told me, FBI name check and
FBI finger check is cleared. But it is still pending with back ground check.
She suggested me to contact attorney.
After I drove hone, it started to snow. I sent the signed contract to
attorney evening.
On Feb 12, SR asked me to wait 180 days for background check. Just last
Tuesday, I call USCIS customer service, it said the last touch may case on
Feb 12.
Today, I got emails from USCIS, our application approved.
The lawsuit is only way.
