Hi, I have a complicated case here. I applied for EB2 on my current position
and the priority date is late 2016. I filed 140 and H1B extension at end of
march this year and got approved. I also applied for H4/EAD for my husband
whose H1B will max out this Nov. Both H1B and EAD got approved through
premium processing and would be effective this October.
Now I want to move to a new position. I have the oral offer but I am
thinking if I can move. I will need to apply for the green card/H1B again as
it is a different company. Then if we apply H1B and H4/EAD together, can my
husband work after we get the receipt or he has to wait until H1B/H4/EAD
get approved? As now there is no premium processing for H1B, it would mean
he has to wait for 6 months probably?

拿到receipt就可以工作了

你只是transfer h1b而已，你本身的工作不需要等待approval。一般只要拿到收据就可
以了。
你的先生只要有有效的H4身份，他的H4 ead就有效。他的EAD是基于H4身份而和谁是你
的雇主有关。也就是说只要你还是H1的身份他就可以用ead工作了。我认为他不需要再
次申请H4／EAD，这点你可以请教下律师比较稳妥。

we still did premium processing at end of March it took only one week to
approve.
