I don't think suing or arguing with the Dean is a productive way to resolve such kind of issues. I would first find a time to sit down with the department chair and go over those problems with him. I would provide him with concrete explanations why not offering you the resources will hinder your research and prevent you from being successful in setting up the lab, recruiting the students, or simply settling down. Then, I will talk with some senior faculties for suggestions. Trying to convince people to support you so you can reach your goal without a fight is the first strategy to consider instead of thinking of moving on to another position. Lack of communication is often times the road blocker for solving such issues any way. You need to go and talk with other professors in your department and get their perspective - people here cannot give you too much suggestions without knowing exactly what goes wrong. I would go out and mix with colleagues at department gatherings as much as I can at the beginning years. I will ask for their suggestions on some of those difficulties I met and seek their suggestions in the so-called "honeymoon period", during which time, they won 't feel that you are whining for help as a complainer would do but will see you as a new faculty who needs help. You will get sympathy and support from senior faculties who want to and can effectively help you out without you asking for it if you are sincere and a good person to work with - let them get to know you and make them enjoy working with you. Be active in department hosted activities and always be supportive in those volunteering activities. I have seen many Chinese faculties hiding in their offices and do not talk much with others. They don't volunteer for activities too. The lone wolf kind of actions, in the long run, will make you estranged from you colleague. When you are in trouble or need support, no one will bother to speak out for you. If you always fight battles by yourself, in most case, you have little chance to win.
This was what happened in my school...we had a new Dean did not honor an offer letter for a tenured professor. The professor sued. Our school council looked at the case and literally told the president of the school to settle because there is no way the school can win. The school settled for over a million dollars and the Dean was relieved of duty. The school council literally was yelling at the Dean for not checking with them first. Also, according to my school faculty handbook, you cannot be fired from the professorship. However, all administrated posts (Dean and chair etc) literally can be taken away from you without notice.
