成都签证,B2,以前B2来过两次美国,分别呆过5个月和3个月。
寄签到广州被退回,要求去成都面签,4月29面签说通过,但是5月3说开始审查,6月19
号做出审查决定,拒签,因为 8 U.S.C. 1182e 的条款。
我妈妈两年前退休,退休前是计划生育局的文职人员,做办公室政策、文档、财会工作
。但是 8 U.S.C. 1182e 的拒签理由是说我妈妈直接参与强制人流和强制绝育工作。
查了1182e,好像很严重,像是长期拒签。可是我们冤枉啊, 她以前来过,没有问题;
她是文职,确实不参与强制人流;而且她已经退休两年;再说我自己就是独生子女,我
们还是活生生的计划生育政策的受害者啊!
真的不知道这下该怎么办了。我把1182e的条款抄下面了。
1182e. Denial of entry into United States of foreign nationals engaged in es
tablishment or enforcement of forced abortion or sterilization policy
(a) Denial of entry
Notwithstanding any other provision of law, the Secretary of State may not i
ssue any visa to, and the Attorney General may not admit to the United
States, any foreign national whom the Secretary finds, based on credible and
specific information, to have been directly involved in the establishment
or enforcement of population control policies forcing a woman to undergo an
abortion against her free choice or forcing a man or woman to undergo
sterilization against his or her free choice, unless the Secretary has
substantial grounds for believing that the foreign national has discontinued
his or her involvement with, and support for, such policies.
(b) Exceptions
The prohibitions in subsection (a) of this section shall not apply in the ca
se of a foreign national who is a head of state, head of government, or cabi
net level minister.
(c) Waiver
The Secretary of State may waive the prohibitions in subsection (a) of this
section with respect to a foreign national if the Secretary—
(1) determines that it is important to the national interest of the United S
tates to do so;
and
(2) provides written notification to the appropriate congressional committee
s containing a justification for the waiver.
