在某学校的官网看到。
The definition of J-1 "duration of status" is the period specified on Form
DS-2019 "plus a period of 30 days for the purpose of travel..."
也就是说grace period期间可以交４８５？
就算有grace period 期间算out of status, 看网上信息，可以用245(k)开赦Eb1(a)
with 140 approved.对吗？

yes, you will need to claim 245k, or I-485 can be rejected in the first
place.

这个245K 不能后补吗？ 485delivery 是在out of status 之前，但是不确定USICS给
RD就是delivery date，有可能会在status 失效后。
这种情况，给面试机会解释吗？

就是因为当初这么以为，才掉以轻心了。
就我在官网看到的，in status 是说 maintain immigration status。J1到期就不是失
去了immigration status。一个月的grace period是authorized stay for travel and
departure.
论坛上看到至少两个case，身份（H1b）结束在grace period里，算有gap，485有问题
的。一个是IO说了一天gap也不成，一个是律师建议从新入境刷新纪录。
J1只有一个月grace period.这一个月内H1b不一定办的下来，能file就不错了。485要
是被拒了，就麻烦大了。

官方的Memorandum 里说：
“ An alien must properly file an adjustment of status application under
section 245(a) in accordance with 8 CFR 245.2 and 103.2. An
applicant invoking 245(k) is not required to submit additional application
forms or payment of a penalty surcharge. Thus, it is
the responsibility of USCIS to determine section 245(k) applicability based
on the evidence submitted in support of the adjustment of status application
.”
就是说，交了485，不用自己claim245K，是USCIS决定用不用245K？

又在某law firm网页，看到如下。现在十分不确定 grace period 算不算 lawful
nonimmigration status.

-1 exchange visitor status after the completion of the particular F-1 or J-1
program. Individuals who are present in a proper grace period are

F1和J1是duration of status的（就是没有固定逗留期的）。grace period是duration
of status里面的，所以是in status。H1b是I-94上有日期的。过了那个日期就out of
status了。入境的时候，
入境官可以（但是不一定会）给逗留期比你H1b petition结束日期长10天；但是无论如
何都是过了I-94上的日期就是out of status。
