公司帮忙办理eb1b,两周前PP 结果rfe
rfe的内容很奇怪，各位版友前辈可否指点下
关于公司部分：需要提供offer letter， w2, 税表（其实都提供了，感觉officer 没
有看到）这部分可以重新提交
个人部分非常奇怪，claim了三样: contribution, publication and review
全部都显示：this criterion has been met
但是在接着的一段话里说："...as discussed above, the beneficiary has not met
at least two of the six criteria. As such USCIS is affording the petitioner
the opportunity to submit additional evidence ..."
这种情况下应该怎么办呢？还需要个人提供资料吗？

好像是模板回复，3条达到了，但是没有到top级别。
你在班上搜搜帖子看看。

eb1b的RFE一般都是资质问题，如果是个人条件问题一般都是noid。
不过话说您好歹也把RFE通知多写点上来啊，要不然谁知道怎么回事。。。。

个人部分具体是:
六个条件下方，前三个是：No evidence has been provided for this criterion
后三个是：This criterion has been met.
然后是：
As discussed above, the beneficiary has not me at least two of the six
criteria. As such, USCIS is affording the petitioner the opportunity to
submit additional evidence to establish the at the beneficiary meet the
regulatory criteria outlined above. The respond to this request should
address the insufficiencies articulated by USCIS in this request. (但是没有
articualte的部分，每个条件下放都是上面这个简单的一句话）
Merely meeting the minimum regulatory criteria outlined above will not
establish eligibility for the E12 immigrant classification. Any evidence
submitted in response to this request, should also articulate how the
evidence establishes that the beneficiary possess the required high level of
expertise for the E1w immigrant classification.
This is the petitioner's opportunity to articulate further details of
provide addition al evidence in regard to how the evidence submitted in the
initial filing or in response to this request for evidence established that
he beneficiary meets the requirements regarding the required high level of
expertise for the immigrant classification.
Establishing eligibility for the high level of expertise requires fro the
E1w immigrant classification is based on the beneficiary being recognized
internally as outstanding in the academic field specified in the petition.
In conclusion, when ultimately making a final decision regarding eligibility
, we will
A. first evaluate the evidence submitted by the petitioner to determine
which regulatory criteria the beneficiary meets in part one;
B. then evaluate the evidence together in its entirety to make a final
metric determination of whether for not the petitioner, by a preponderance
of the evidence, has demonstrate that the beneficiary is recognize
internationally as outstanding in the academic field specified in the
petition
This is the petitioner's opportunity to meet the legal burden of prof to
establish eligibility in all respects. Whenever any person makes an
application for an immigrant benefits, they shall bear the burden of prof to
establish eligibility for the benefit sought. there for the petitioner mush
prove, by a preponderance of the evidence, in other word, that is more
likely than not, the beneficiary is fully qualified for the benefits ought.
Accordingly, the decision will be based on the initial evidence submitted
upon filing and all additional evidence submitted in respond to this request.

是不是说明满足了最低要求三条但还不是internatinaly outstanding.所以需要全面
补充材料

其实也不一定，我看很有可能这个IO用模板时候那句话忘删了。
其实RFE的还是没看到的公司税表等财政情况，虽然你说提交了。
对于1B，我看法和3楼一样，如果是质疑三条totality，多数是NOID，既然公司付了钱
的律师，有问题看律师怎么说

收到了纸板的这个notice，还没根律师谈。估计大概率是再写推荐信了

我记得前几个月在版上见过一个类似的case，3条都met，被RFE别的东西，你搜搜看，
问问那个人怎么回复的？

公司律师回复吧，看他怎么说。不过提醒一下，公司部分，重新提交的时候核对一下是
否有什么遗漏，还有在respond这个criteria，还是要认真回复满足，逐条回应，不要
掉以轻心
