昨天刚收到140被拒消息，老婆由于去年H1B没抽中OPT extension用完，10月之后一直

是的，她在使用485/EAD的时候，已经没有身份，只是可以合法居留和工作。
140被否决之后，485也就同时被否决了。她也就失去了在美国合法居留和工作的基础。

所以，收到拒条的时候，日期一般是一个星期左右之前。
法律上讲，就应该离境了。
当然，执行的时候，估计可以argue，在正式拿到之后再离境。

这段话意思即使身份有过期，但是只要180天之内，交485 AOS可以过，过了180天，就
有3年的bar了，所以你也可以认为grace period有180天，但其实不是grace period，
而是out of status但是不影响下次AOS的最大上限天数。比如你这情况现在没有身份了
，过了30天转到了H签证，下次再交485，即使有这30天算是out of status的，但小于
180天，也是可以顺利批的

day, it is also possible the 485 is denied several months later after the
130/140 rejection.
If your 140 is denied but 485 is still pending, you can submit another 140
application ASAP and hope the pending 485 be linked to the new 140 by

USCIS system links the pending 485 to the most recent 140 petition
automatically, especially if the new 140 is approved before the 485 is
denied.
BTW, you cannot and should not make a 485 relink/transfer request
when you submit the new 140 petition.

谢谢你的回复。律师从不有提过这件事。我的情况是140和485 cc 现在140被拒，485还
在pending。我在网上看到现在我的485理论上已经失效，因为我的485是在140被批准基
础上的。但也有人说因为我的485还在等待结果，如果我现在马上提交一个新的140pp通
过的话，那我的485还没准儿可以自动连接到新的140上。但至少从USCIS网站上我没有
得到任何确凿的信息。

You can submit an EB1A 140. If your new 140 is approved, your 485 is still
pending, and your PD is current under EB1, you can make a relink/transfer
request.

In theory, you cannot make a 485 relink/transfer request if the underline
140 has been withdrawn, denied, or revoked.
But you want to submit a new EB1 140 as early as possible, correct? So do it
before your 485 is denied. You have nothing to lose.

140 has been withdrawn, denied, or revoked.
But you want to submit a new EB1 140 as early as possible, correct? So do it
before your 485 is denied. You have nothing to lose.

太感谢了！那副申请人已经在用的eb1b的ead卡会因为relink受影响么？

If the original adjustment application was based on a petition determined to
have been filed fraudulently or with willful misrepresentation, the
principal adjustment applicant or the beneficiary of that petition is
considered to have never been eligible for adjustment of status and
therefore cannot meet the continuing eligibility requirement.
Likewise, anyone whose adjustment application is dependent upon that
principal adjustment applicant’s eligibility is also ineligible. If a
principal’s adjustment application is denied based on a determination of
fraud, any accompanying derivative’s application must also be denied.
