what do you mean by AP? if I-512, that AP is based on pending I-485 and irrelevant to you. You only need to make appointment using the H1B's I-797 to apply for H4 visa stamp, usually it is decided by VO on the spot whether your visa is approved or denied.

Sorry for this ambiguity, just realised AP could also mean advanced parole. Here I meant administrative processing. My EB1 application at the consulate is still under AP, and I reckon it could go on so until the new fiscal year. In this case, do you think my H4 application would be approved? Thanks again!

ok, "background check" can be used as an excuse to postpone your H4 visa stamp approval for weeks (or a few months).

That's what worries me. Do you think my H4 application would get refused on this basis? I'm OK with a few weeks or even a couple of months, but if it goes along with my EB1 AP, which will sooner or later be held on because of this visa availability limit, that could be a long wait.
