现在是第二轮H1B，年底到期。EB1A 140正在递交，打算直接加急。问我们HR，HR说You
can
extend H-1B with an approved I-140 and a retrogressed priority date.
现在我有一块不太清楚，脑子有点乱。
假设我140下个月递交，两周之后批准了，假设啊。priority date是retrogress还是
current是在140批准以后还是485递交以后？
大家有什么建议吗？非常感谢！

你现在current吗？那个规则不是光看申请extension时。好像还有半年还是1年的要
求，就是140批了，如果pd c了不能为了h1b而故意不交485。还有pd c不c好像只觉
定h1是延1年好是3年。。。所以不是大问题

我现在还没批140呢，只是律师说我的case比较强没问题，所以希望加急很快拿到140批
准。
我的问题是按照HR的话，不知道什么才能知道可以延期H1B。。。。。。。。。这个地
方我有点没搞清楚。
current还是retrogress是什么时候什么情况才能知道？

Your priority date will be in 2019, and your employer can renew your H1B
immediately after your 140 is approved.
When your employer submits your H1B application to USCIS,
1. if your PD is current, you will receive 1-year H1B extension;
2. if your PD is not current, you will get 3-year H1B extension.

我问HR: Currently it is my 2nd round H1B, which will expire on 12/30/2019.
That means I cannot renew/extend H1B for a 3rd round even if I get I-140
approved, right?
HR的回答是：Correct - unless your home country is retrogressed. Best
practice is to reach out to the attorney that you are working with for
additional guidance around this.
HR的意思是要extend H1B必须两个条件：一个是140 approved了，另一个是必须
retrogressed。
第一个我好理解，第二个我不太明白，怎么样是retrogressed了。就这个点上有点迷糊
。

140马上就交，乐观的话加急很快就会批。现在没搞明白的是H1B能够renew的时间。非

1类近期不可能current，即retrogressed。140批了就可以续3年。

My advise: ignore your HR's response (not completely correct but confusing)
and talk to your immigration lawyer.

我现在是律师和HR两边问来问去的，但是不得要领。
律师的回答是：
As our firm does not handle H-1B visas, you will need to address specific
questions about the extension process to your employer's attorney or an H-1B
specialist. An approved I-140 does allow you to extend your H-1B beyond the
six-year cap, but we cannot confirm the deadline for filing an extension.
而且不按照HR说的来，达不到他的要求，HR不给办理H1B延期。

In your case, the law allows your employer filing an H-1B extension for you
after your I-140 is approved whatever your PD is current or not (EB1 China
is retrogressed or not). But your HR/employer may have some internal polices
to limit H-1B extension if your PD is current.
Anyway, I don't think your PD will become current when your I-140 is
approved. Your H-1B extension should be fine.

You CANNOT file 485 with 140 concurrently based on the current EB1 China
cutoff date in Visa Bulletin.
Have your 140 done ASAP!

PD不就是今年吗？怎么就retrogress了呢？
楼里面的人以为楼主明白EB1 retrogressed的事，统统纠结在HR律师给不给办H1b上了
。驴唇不对马嘴。
给楼主：
建议你先去研究一下PD，排期，retrogression是什么意思。随便搜一个办绿卡流程一
般都有讲。排期要看visa bulletin（again，建议你去学习一下什么是visa），在这里

现在EB1类别全世界都retrogressed，中国更是只排到17年，你的国家当然retrogress
。但是HR又不知道你是哪个国家，办什么类别；万一你是台湾人办EB2-NIW，你就不是
retrogress了。
关于你这个H1b的问题：
我也不知道第六年续H1b是怎么弄的，所以不能给你建议；但我可以给你翻译一下你HR
的话：
“我不知道你哪个国家来的，也不知道你打算办哪个类别，所以不知道你现在办140排
期是否当前。如果你办了140，又排期当前，你就可以立刻递交485了，就不能再续H1b
了。除非你140批了，有了PD，但是由于你的国家有排期（也就是country is
retrogressed），我们才能给你办H1b。”
总结：你先去补一下这些名词知识，最后我建议你还是找律师吧。

retrogressed priority date按照我的理解就是当年没叫上号？
HR知道我是EB1A，我给HR的email里面都说了，copy的那一句是其中一部分。
请了律师来帮我做140paperwork，律师也问了，但是感觉律师不想回答H1B renew的问
题，所以跑来问大家。
不过我听你的，去学习一下这些名次。

说白了就是能不能交485，看排期。假如你今天投的，uscis收到的receipt date是6/14
/2019，这个140批了的话，6/14/2019就是你的排期。然后看表，你是eb1，你的排期得
在cutoff之前才能递485。果断没到，不能递，按AC21，6年用完前可以续3年h1b。假如
current，递485，只能续一年。明白了么？
