现在在等一个面试的结果,但是离60天grace period只剩三周,HM说下周五会给我
update,因为可能还会面其他人,不能保证在三周能给结果。
60天结束前我可以change status to F2来维持身份。我也不指望能PP了。不过如果HM
知道哪怕给了offer,还得再等4-6个月,估计这个offer不保。
看到有的说办transfer拿到receipt就可以上班,
也有说被approve之后才能上班。请问拿receipt上班违不违法规?我知道approve之后
肯定是最稳妥的。
另外办LCA+提交H1B申请至少要多少天?

大侠知道下面这个情况么?
如果我办了F2申请,在F2 pending之后,从公司提交transfer H1b申请 到 我出境面签
H1b,是必须等transfer approve么?还是说可以拿着receipt可以立刻出境约H1b面签
,而不用等几个月。

在grace period期间不能用receipt开始合法工作,DHS对此有正式的、明确的回答。实
际上这个grace period以前就在审批实践操作中存在,只是现在正式确定成文公布了。
可查阅这个文件:Retention of EB-1, EB-2, and EB-3 Immigrant Workers and
Program Improvements Affecting High-Skilled Nonimmigrant Workers
DHS declines to provide employment authorization during the grace periods.
Consistent with the intent of the grace periods as proposed, as well as
similar grace periods already provided in DHS regulations, the final rule
does not allow eligible nonimmigrants to be employed during either the 10 or
60 day grace periods unless otherwise authorized under 8 CFR 274
DHS authorizes these grace periods simply to facilitate the ability of
qualified nonimmigrants to transition to new employment in the United States
, seek a change of status, or prepare to depart the United States.
Consistent with longstanding policy, DHS declines to authorize individuals
to work during these
grace periods.

办LCA理论上7天,有经验的律师基本上不需要准备什么就可以在你接了OFFER后立即提
交,在等待LCA批复的同时可以准备好H1B transfer文件。
但是你在grace period提交H1B申请后不能用receipt合法工作。

可以合法工作,上面长篇说明是说你H1B雇员身份失效后不能工作,和拿到receipt上班
没有冲突,拿到receipt潜在你就是H1B身份,H1B实际上从receipt之日起就开始了,除
非你后面没有批准。你copy的文字没有提到receipt不能上班,不要断章取义

我在六楼贴的这段话一共才二句,算不上长篇,是DHS制定规则期间对网上相关comment
的回答。
请你仔细读读,DHS明明白白写了最后结论:
“the final rule does not allow eligible nonimmigrants to be employed during
either the 10- or 60-day grace periods unless otherwise authorized under 8
CFR 274a.12. ”
请看:“UNLESS OTHERWISE authorized under 8 CFR 274a.12.” 这句话就等同于说
持H1B申请的receipt不能被雇佣。
除非你满足 8 CFR 274a.12列出的条件之外,不允许在grace period工作。去找找 8
CFR 274a.12 耐心读读吧,里面并没有包含H1B申请的 “receipt”。
我“断章取义”?
你读了全篇,那么请给大家贴出支持在grave period时持新雇主H1B transfer receipt
可以合法工作的、被我“断”掉的那些章节。
我真心希望你是对的,很可惜不是。
过去和目前的政策,都是只有在失去老公司的工作前拿到新公司提交申请的receipt 才

你说得对, H1b失效了确实要出境重新激活.

移民律师说laid-off后用receipt可以开始工作。

The regulations provide clarity regarding when a laid-off H1B worker, who
finds new employment, is permitted to resume working. In order to qualify
for portability under AC21, the new H1B petition must be filed while the
worker either is in H1B status or has a timely filed H1B extension petition.
“In-status” includes the grace period described above. Therefore, if an
H1B change-of-employer request is filed during the grace period, the H1B
worker typically is permitted to resume working upon the filing of the
petition.

你现在是什么身份呢?要是还是H1b,那就是H1B transfer,拿到receipt就可以工作的
;要是你现在已经是H4或者F2或者H1B已经失效了,那新的公司给你办的就不再是H1B
transfer了,而是个新的H1B petition,只是不占quota而已,这个就必须得等到
approved以后才可以上班。

转:同样在final rule里,另外有一条,明确说了grace period内是可以适用

Finally, the final rule at 8 CFR 214.1(l)(3) makes clear that the
nonimmigrant worker, during either a 10-day or 60-day grace period, may
apply for and, if otherwise eligible, be granted an extension of stay or
change of status. The beneficiary may also commence employment under H-1B
portability per § 214.2(h)(2)(i)(H), discussed in some detail below,
if otherwise eligible. To further effectuate the intended purpose of these
provisions, DHS is also making clarifying edits to the regulatory text at §
 214.1(l)(2), and (l)(3).所以在grace period期间找到下家也是可以拿到

说一下亲身经历:
60天 grace period 内
甚至不必等到 I-797C receipt
只要拿到 I-129 寄到 USCIS 的 delivery confirmation
就可以开始工作

Once we file you are legally entitled to start
the following day since you already in valid H-1B status.
You may do this before receiving the Receipt Notice,
using the Fed Ex delivery confirmation as a placeholder
for I-9 purposes until the Receipt Notice is delivered.

to port and start working upon the filing of the H-1B petition with USCIS,
wait until the official USCIS receipt notice is issued, before starting with

petition has been properly filed and there is no risk of the case being
returned.
If you prefer to start working upon Federal Express confirmation of
delivery of the petition to USCIS, you, the employee, must fully accept
all risks that come with starting before the official USCIS receipt has
been issued. They include, but are not limited to, the following:
1. The possibility that the petition can be returned for reasons beyond
our control. Should the case be returned, it will then have to be re-filed.
2. If the case is returned, there will be a period where you will have
worked without work authorization, which may affect your eligibility
for the extension once the petition is re-filed.
3. If the petition is denied, you will have to exit the U.S. and possibly
apply for a new H-1B visa (if your visa in your passport has expired)
before you would be able to start working again in H-1B status.
4. If the petition is returned or denied, you must immediately go on
unpaid leave of absence until you once again have legal work status.
5. If you need to go on unpaid leave of absence, you accept any
unintended impact that may have on your benefit programs such as
medical plan participation or stock option vesting (for example).
By signing below, you are expressly confirming that you wish to start
working with us upon Federal Express confirmation of delivery of
the petition to USCIS and fully accept the risks detailed above.
