请问关于科研专利归属权的问题# Law - 律师事务所

请问如果在University professor在科研的过程中发现专利,那么这个专利是否归大学
和教授共有呢? 看法案的话,感觉归属权好像是属于大学而不是发明人,如果大学把这个
专利卖给公司,那么作为发明的个人和他的组能够分得多少呢?
如果是在国家机构,情况又如何呢?

Usually the employment contract would say all patent rights belong to the
employer. Read yours. Very likely your contract has that language.

Highly unlikely.
It's like you work at a Ford manufacturing plant, and you ask Ford if you
can take home the cars (or scrap metal).

Normally, it's shared by grant institute, university, and inventers.
You have to read the policy to figure out the percentage of share for
inventers.
