大家好，
我不是学法律的，但是这个学期开了一门商业道德的课程，结果学校请了一个lawyer来
讲课。问题就来了，他只是不停的讲律师的思维啊，案例啊，很多法律的东西，一点书
上的东西都没有，也没有任何板书可以让我温习。现在出了几个作业题，我想请教一下
法律大侠们，谢谢了!
1.what are the two types of causation? explain each and further explain what
purpose the element of causation serves in a tort claim?
2. In failure to disclose fraud, a certral element is whether a defendant
has a duty to disclose. Describe the test for such a duty, including
situations where courts may not find a duty, and state whether such duty

I suggest you to talk with the faculty/lawyer about your difficulties in
keeping up with his lecture and ask for his help or guidance.

A lawyer who thinks he is superior to the rest. What a surprise.
Question 1 is torts. Question 3 is Constitutional Law. Question 2 could be
torts, contracts, or criminal law.
The 2 causes are direct cause (cause in fact) and proximate cause (cause in
law). The other 2 questions don't have "right answers."

for 2, your search term is incorrect. "failure to disclose" is one type of
fraud. your understanding of "a duty to disclose the fraud" isn't right. a
example that came to my mind is that in the real estate transaction context
, whether the seller has a duty to disclose major damages to his/her
property to the buyer. this type of duty exists in many legal contexts.
try "torts", "fruad", "intent", "failure to disclose" etc.
