buyer's rebate is just between buyer and his/her agent. seller doesn't care since seller will provide that part anyway and it has been written in the listing agreement.

This is just formality. I am asking if the commission can now be lowered to be much lower than conventional 6%??

I am OK with merit based pay. But 3% is a flat rate rather than a merit based reward. Every agent, no matter how much time and effort he/she spends, is getting 3%. How is that fair? By the way, I didn't ask for buyer agent rebate when I bought my house.
not all sales are based on 6% of commission. seller normally will discuss this with the listing agent and depends on the market, condition of the property and the price that the seller asks for, listing agent may lower their part of commission. the average is about 4 to 5%, not 6%. Also, for price over $1m, most of them are less than 5% due to the total amount. this is a case by case situation.
