合同说close on or about Feb 28;律师说就是seller在Feb 28之前或之后30日都不算 违约。但是因为seller的原因导致closing delay,现在mortgage commitment letter 已过期,我们要付extension fee。 在合同中有下面这个条款,说是如果title有问题,seller可以选择remedy,如果选择 remedy,时间不能超过60天或commitment expire。我们closing delay就是因为seller 有violations,导致title not clean,seller选择remedy,虽然现在title clean可以 closing了,但是我们的mortgage commitment已经过期。根据下面这个条款,可否要求 seller付extension费,或直接撤销合同拿回deposit? Title examination; seller's inability to convey; limitations of liability "If Seller elects to take action to remove, remedy or comply with such Defects (in our case, the violations), Seller shall be entitled from time to time, upon Notice to Purchaser (I don't recall we have received anything), to adjourn the date for Closing hereunder for a period or periods not exceeding 60 days in the aggregate (but not exceeding beyond the date upon which Purchaser's mortgage commitment, if any, shall expire), and the date for closing shall be adjourned to a date specified by Seller not beyond such period."

do you still want this property or not? if not, talk to your agent and try to cancel it. the seller should be already in default if they haven't request for closing extension and you should be able to get your EM back. good luck.
