买房过程中遇到问题，真诚请教。
在NJ买了一个小condo，贷款过程中出问题了。Loan officer没有帮我们lock in rate
，事前没有告诉我们，到要close的前几天才打电话告诉我们了，这时利率已经涨了很
多。我们交涉后无果。想问问懂行的朋友，这种情况下我们可以选择不close吗？我们
的律师说seller会告我们。但我看见版上vegas买房＂亏＂七万的那位朋友也walk away
，拿回了deposit，所以想听听大家的意见。谢谢！

你的contract应该是loan contigency，上面应该写着得到rate<=x.x%的loan。
如果你没有这个，你被agent骗了。

in a seller market, buyers cannot put many contingencies in the contract.
afaik, many buyers don't have appraisal & mortgage rate contingencies.

我们没有这一条。rate那一栏是空的。
我们要求lender disapprove我们的loan，但对方不肯，说我们qualified。

是的，当时基本上是seller market，priced right的房子一般一周内就被抢了。

所以我一再强调一定要向loan agent要一个lock confirmation
您如果back out, seller当然可以告, 但是这个时间会很长, 在此其间, seller不能卖
房子.

Try this:
(1) Inform the seller that loan with current lender is not going well.
(2) You dump your current lender as they are not very nice to you.
(3) You switch to another lender.
(4) Inform seller that you are performing, but it will take time and there
is uncertainty for loan approval.
(4) You try to get your loan denied by withholding some information such as
income or assets. It is easy to get loan denied by the second lender.
(5) Get your deposit back.
I am not very nice to mean people or sham businesses so I am WSN.

是的，当时大意了。我们以前贷款都没有这个lock confirmation，我根本没想到rate
没有locked，lender出了commitment letter，上面写了利率不超过xxx%。现在他们赖
账了。

不定会得更高价。我是觉得贷款不顺与此房无缘，所以不想要了。但如果walk away，
估计seller会敲一笔。

上来update一下，今天终于close了。rate后来lock在了一个稍低一点的利率上，当然
比最初高很多了，但比现行利率低一点。然后我们put in更多的down payment，降低了
mortgage amount，这样interest lifetime比原来稍低，每个月的payment也比原来稍
低，所以最后还是close了。感谢楼里各位帮忙出主意的网友！
