final walk through出了问题,热水器的阀门掉了地下室被淹,长了霉。现在我们坚决 要退出合同并且要求退回我们的5000块的押金,签了协议给对方发过去,律师也几次通 知对方我们要取消合同。对方就采取对我们不理不睬的态度,坚决不签协议。。。这种 情况怎么办?打官司还是去attorney general去投诉?
谢谢建议。 我们的contract上有一个是关于final walk through的,说seller必须在 close前保持房子,nuyer有权final walk though检查。还有一个是loss of use,就是 说close前如果有damage/casualty,seller承担责任,buyer可以选择cancel。问题是 我们觉得 contract说的清清楚楚,但律师说nys规定必须给Seller一个cure的机会。我 们已经给过一次机会了,他们说弄好了,结果我们发现房子发霉了。 我们不能无限制 给时间让他们cure吧?
my 2 cents. all parties except you want to close this deal, so they can pocket the money and have a party. your agent and your lawyers do not have incentive to fight for you to break the deal because they will lose money if they do so.
if go to court, the seller will never be able the sell the house until the case is settled. So the seller will not want to go to court unless the seller changed mind and not want to sell any more. (If i were the seller, i will try to negotiate.) you have the money, and no body can force you to buy the house. no body can cash the deposit for now. you need to read the contract carefully and find if there are any clauses that cover this kind of scenario. If not, then you certainly have some ground the argue. If yes, you can certainly use the clause to negotiate. you have a lot to argue with. For example, you can argue that the fix is not sufficient. You can ask them to show they hired a licensed contractor and a bill of the repair. This kind of repair is expensive when done by a contractor. You can argue the potential damage say mold to the other part of the building and ask have that assessed and repaired if necessary by licensed professionals. The point is to try to argue in a seemingly reasonable way and use whatever you can hold onto. i would guess the seller have more pressure than you on this issue. Take your time. From now, keep every record and put everything in formal letters. Do not take anything orally communicated. Firmly indicate you are preparing to go to court.

you have a clear upper hand. the worst worst case is that you loose the deposit. in the mean time, you can still buy a house and enjoy your life. the seller, on the other hand, has much more to loose.
